 AN ACT to amend the general business law, in relation to requiring warn-
   ing labels on drinks containing tapioca pearls
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The general business law is amended by adding a new section
 399-k to read as follows:
   § 399-K. WARNING LABELS ON DRINKS CONTAINING  TAPIOCA  PEARLS.  1.  ON
 EVERY  DRINK  CONTAINER  CONTAINING  TAPIOCA  PEARLS,  COMMONLY KNOWN AS
 "BUBBLE TEA", SOLD WITHIN THIS STATE, THERE SHALL BE PRINTED THEREON  OR
 ATTACHED THERETO A WARNING LABEL. SUCH LABEL SHALL CONTAIN THE FOLLOWING
 STATEMENT:    "WARNING:  THE  TAPIOCA PEARLS FOUND IN THIS PRODUCT ARE A
 CHOKING HAZARD AND CAN LEAD TO DIGESTIVE ISSUES IF INGESTED."
   2. ANY PERSON, FIRM, CORPORATION  OR  ASSOCIATION  WHO  VIOLATES  THIS
 SECTION  SHALL  BE SUBJECT TO A CIVIL PENALTY OF NOT MORE THAN ONE THOU-
 SAND DOLLARS FOR EACH SUCH VIOLATION.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law.
