 AN ACT to amend the public housing law, in relation to imposing require-
   ments on receipt of state funding by certain  housing  projects  in  a
   city with a population of one million or more
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The public housing law is amended by adding a  new  section
 77 to read as follows:
   §  77. CONDITIONS PRECEDENT TO CERTAIN STATE FUNDING. 1. NOTWITHSTAND-
 ING  ANY  PROVISION  OF  LAW  TO  THE  CONTRARY,  NO  PROJECT  FOR   NEW
 CONSTRUCTION,  RECONSTRUCTION  OR REHABILITATION OF HOUSING LOCATED IN A
 CITY WITH A POPULATION OF ONE MILLION OR MORE SHALL BE ELIGIBLE FOR  ANY
 SOURCE  OF STATE FUNDING, INCLUDING BUT NOT LIMITED TO, LOANS, SUBSIDIES
 OR TAX INCENTIVES UNLESS THE COMMISSIONER FINDS THAT A MINIMUM OF THIRTY
 PERCENT OF THE DWELLING UNITS IN SUCH PROJECT  ARE  DESIGNATED  FOR  LOW
 INCOME HOUSING.
   2.  SUCH  FINDINGS  SHALL  BE CONCLUSIVE EVIDENCE OF THE FACTS THEREIN
 CONTAINED EXCEPT UPON PROOF OF  FRAUD  OR  WILLFUL  MISFEASANCE  BY  THE
 COMMISSIONER.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.

 AN ACT to amend the public housing law, in relation to imposing require-
   ments on receipt of state funding by certain  housing  projects  in  a
   city with a population of one million or more

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public housing law is amended by adding a  new  section
 77 to read as follows:
   §  77. CONDITIONS PRECEDENT TO CERTAIN STATE FUNDING. 1. NOTWITHSTAND-

 LOW INCOME HOUSING. A NUMBER OF SUCH DESIGNATED DWELLING UNITS  EQUALING
 TWO PERCENT OF THE TOTAL DWELLING UNITS IN SUCH PROJECT SHALL BE OFFERED
 TO THE CONSTRUCTION WORKERS WHO WORKED ON THE PROJECT THROUGH A LOTTERY.
   2.  SUCH  FINDINGS  SHALL  BE CONCLUSIVE EVIDENCE OF THE FACTS THEREIN
 CONTAINED EXCEPT UPON PROOF OF  FRAUD  OR  WILLFUL  MISFEASANCE  BY  THE
 COMMISSIONER.
   §  2.  This  act shall take effect on the ninetieth day after it shall
