BILL NUMBER: S121 SPONSOR: ORTT TITLE OF BILL: An act to amend the agriculture and markets law, in relation to requests for public information regarding certain farm operations PURPOSE OR GENERAL IDEA OF THE BILL: To require notification to the owners and/or operators of a farm opera- tion when information about their farm operation has been requested via the Freedom of Information Law from a state agency or entity. SUMMARY OF SPECIFIC PROVISIONS: This bill amends Agriculture and Markets Law to create a new Section 308-b that requires the owner or operator of a farm business as defined in Section 301 of Agriculture and Markets Law to be notified that their farm records or business information has been requested from a state agency/entity via FOIL upon submission of the FOIL request to the state

ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to requests for public information regarding certain farm operations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The agriculture and markets law is amended by adding a new section 308-b to read as follows: § 308-B. NOTIFICATION OF FOIL REQUEST. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, UPON THE REQUEST OF ANY PERSON OR ENTITY FOR ANY RECORDS OF A FARM OPERATION, AS DEFINED IN SECTION THREE HUNDRED ONE OF THIS ARTICLE, FROM AN AGENCY OR OTHER STATE ENTITY; THE AGENCY OR STATE ENTITY OF WHICH THE REQUEST HAS BEEN MADE SHALL INFORM THE OWNER AND/OR OPERATOR OF SUCH FARM OPERATION IN WRITING THAT A REQUEST FOR RECORDS CONCERNING THEIR FARM OPERATION HAS BEEN SUBMITTED, PROVIDE A DESCRIPTION OF RECORDS REQUESTED AND PROVIDE THE NAME AND ADDRESS OF THE PERSON OR ENTITY REQUESTING SUCH RECORDS. NOTIFICATION OF THE FARM OPER- ATION IS TO BE MADE BY THE AGENCY OR STATE ENTITY WITHIN FIVE BUSINESS DAYS OF SUBMISSION OF THE RECORDS REQUEST BY THE PERSON OR ENTITY SEEK- ING SUCH RECORDS. § 2. This act shall take effect immediately and the commissioner of agriculture and markets is hereby authorized to add, amend and/or repeal any rule or regulation necessary for the implementation of this act on its effective date.
