TITLE OF BILL:

An act authorizing the alienation of certain parklands in the town of
Hastings, county of Oswego

 
PURPOSE:

To alienate and convey a parcel of land currently used as parkland in
the town of Hastings .

 
SUMMARY OF PROVISIONS:

Section 1 authorizes the town of Hastings to discontinue as parklands,
the lands described in Section 3, for sale at fair market value, to the
New York State Police Department.

Section 2 provides that the land described in Section 3 may only be
discontinued if the town of Hastings dedicates an amount of land equal

to or greater than the fair market value of the proposed discontinued
parkland, towards the acquisition or upkeep of new or existing park and
recreational facilities.

Section 3 provides a description of the proposed discontinued parkland
to be sold at fair market value to the New York State Police by the town
of Hastings.

Section 4 provides that if the parklands described in Section 3 have
received funding from the federal land and water conservation fund, then
the discontinuance of the parklands will not happen until all federal
requirements are complied with pertaining to the conversion of parkland.

Section 5 is the effective date.

 
JUSTIFICATION:

This legislation authorizes the town of Hastings in the county of Oswego
and the state of New York to discontinue the area described in Section 3
as parklands, and to transfer that land at fair market value to the New
York State Police Department for the construction of a New York State
police station.

Authorization for the discontinuance of the parkland described in
Section 3 is dependent on the town dedicating an amount equal to or
greater than the property transferred, for the acquisition of new park-
lands and/or for improvements to existing parklands.

This legislation further provides that if the proposed discontinued
parklands have received funding from the federal land and water conser-
vation fund, then the parklands may not be discontinued until all feder-
al requirements are met pertaining to the conversion of parkland.

 AN ACT authorizing the alienation of certain parklands in  the  town  of
   Hastings, county of Oswego
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding section 2 of chapter 325  of  the  laws  of
 1920,  subject  to  the provisions of this act, the town of Hastings, in
 the county of Oswego, acting by and through its governing body and  upon
 such  terms and conditions as determined by such body, is hereby author-
 ized to discontinue as parklands and to sell pursuant to section 72-h of
 the general municipal law, the lands described in section three of  this
 act,  to the New York State Police Department for the purpose of provid-
 ing necessary land for the construction  of  a  New  York  State  police
 station.
   § 2. The authorization contained in section one of this act shall take
 effect  only upon the condition that the town of Hastings shall dedicate
 an amount equal to or greater than the fair market value  of  the  park-
 lands being discontinued towards the acquisition of new parklands and/or
 capital improvements to existing park and recreational facilities.
   §  3. The parklands authorized by section one of this act to be alien-
 ated are described as follows:  All that tract or parcel of land situate
 in The Town of Hastings, County of Oswego and State of New  York,  being
 part  of  Lot  No. 28 and being part of Lot No. 29 in Township No. 13 of
 Scriba's Patent, and being part of the lands conveyed from F. Don  Sweet
 to the Town of Hastings by deed dated April 16, 1969 and recorded at the
 Oswego  County  Clerk's Office on April 16, 1969 in Book of Deeds 712 at
 Page 116 and being more particularly described as follows:
   Beginning at the southwesterly corner of lands of The Town of Hastings
 (712/116), being a point on the southerly bounds of  Lot  No.  28,  also
 being the centerline of Wilson Road per deed (712/116), said point being

 easterly  a distance of 645 feet, more or less, from the nominal center-
 line intersection of Wilson Road and U. S. Route No. 11;
   Thence running N. 28° 53' 09" E. along the easterly bounds of The Town
 of  Hastings  (712/141)  a distance of 435.60 feet to a point; thence S.
 61° 57' 15" E. a distance of 300.00 feet to a point; thence S.  28°  53'
 09"  W. a distance of 435.60 feet to the southerly bounds of Lot No. 29;
 thence N. 61° 57' 15" W. a distance of 300.00  feet  to  the  point  and
 place of beginning containing 3.0 acres of land, more or less.
   Subject  to  any  and all easements and restrictions of record and the
 highway rights of the public and the Town of  Hastings  in  and  to  the
 portion  of  Wilson  Road lying within the bounds of the above described
 parcel.
   § 4. If the parkland that is described in section three  of  this  act
 has received funding pursuant to the federal land and water conservation
 fund,  the discontinuance of parklands authorized by section one of this
 act shall not occur until the town of Hastings  has  complied  with  the
 federal  requirements pertaining to the conversion of parklands, includ-
 ing satisfying the secretary of the  interior  that  the  discontinuance
 with  all conditions which the secretary of the interior deems necessary
 to assure the substitution of other lands shall be  equivalent  in  fair
 market  value  and recreational usefulness to the lands being discontin-
 ued.
   § 5. This act shall take effect immediately.
