 Introduced  by Sens. PARKER, BENJAMIN -- read twice and ordered printed,
   and when printed to be committed to the  Committee  on  Investigations
   and Government Operations
 
 AN  ACT  to amend the executive law, in relation to the authority of the
   attorney general to review incidents where a civilian is killed  by  a
   police officer

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 63 of the executive law is amended by adding a  new
 subdivision 17 to read as follows:
   17.  REVIEW  ANY INCIDENT INVOLVING THE CONDUCT OF A POLICE OFFICER IN
 CONNECTION WITH THE PERFORMANCE OF HIS OR HER OFFICIAL  DUTIES,  WHEREIN
 SUCH  CONDUCT IS ALLEGED TO HAVE CAUSED THE SERIOUS INJURY OR DEATH OF A
 CIVILIAN, WITHIN SIXTY DAYS OF  THE  INCIDENT.  UPON  SUCH  REVIEW,  THE
 ATTORNEY  GENERAL  SHALL  DETERMINE  WHETHER  THE INCIDENT BEING BROUGHT
 FORTH WILL REMAIN WITHIN THE JURISDICTION OF THE LOCAL  DISTRICT  ATTOR-
 NEY'S OFFICE OR BE PROSECUTED UNDER THE JURISDICTION OF A SPECIAL PROSE-
 CUTOR APPOINTED BY THE GOVERNOR.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
