TITLE OF BILL: An act to amend the insurance law, in relation to
requiring insurance coverage for pre-exposure prophylaxis and post-expo-
sure prophylaxis to prevent HIV infection
PURPOSE:
The purpose of this legislation is to require that any insurance policy
which provides coverage for prescription drugs shall include coverage
for the cost of pre and post-exposure prophylaxis for the purposes of
HIV prevention.
SUMMARY OF PROVISIONS:
Section 1 amends section 3216 of the insurance law by adding a new para-
graph 34.
Section 2 amends section 3221 of the insurance law by adding a new para-
graph 20.

AN ACT to amend the insurance law, in relation to requiring insurance
coverage for pre-exposure prophylaxis and post-exposure prophylaxis to
prevent HIV infection
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subsection (i) of section 3216 of the insurance law is
amended by adding a new paragraph 35 to read as follows:
(35) EVERY POLICY WHICH PROVIDES COVERAGE FOR PRESCRIPTION DRUGS SHALL
INCLUDE COVERAGE FOR THE COST OF PRE-EXPOSURE PROPHYLAXIS (PREP) FOR THE
PREVENTION OF HIV AND POST-EXPOSURE PROPHYLAXIS TO PREVENT HIV
INFECTION.
§ 2. Subsection (l) of section 3221 of the insurance law is amended by
adding a new paragraph 21 to read as follows:
(21) EVERY POLICY WHICH PROVIDES COVERAGE FOR PRESCRIPTION DRUGS SHALL
INCLUDE COVERAGE FOR THE COST OF PRE-EXPOSURE PROPHYLAXIS (PREP) FOR THE
PREVENTION OF HIV AND POST-EXPOSURE PROPHYLAXIS TO PREVENT HIV
INFECTION.
§ 3. Section 4303 of the insurance law is amended by adding a new
subsection (ss) to read as follows:
(SS) EVERY CONTRACT ISSUED BY A HOSPITAL SERVICES CORPORATION OR A
HEALTH SERVICES CORPORATION WHICH PROVIDES COVERAGE FOR PRESCRIPTION
DRUGS SHALL INCLUDE COVERAGE FOR THE COST OF PRE-EXPOSURE PROPHYLAXIS
(PREP) FOR THE PREVENTION OF HIV AND POST-EXPOSURE PROPHYLAXIS TO
PREVENT HIV INFECTION.
§ 4. This act shall take effect immediately.
