BILL NUMBER: S3472 SPONSOR: HELMING TITLE OF BILL: An act to amend the criminal procedure law, in relation to granting bailiffs in the village of Palmyra in Wayne county peace officer status PURPOSE: This bill would provide peace officer status for bailiffs employed by the Village of Palmyra. SUMMARY OF PROVISIONS: Section 1: Amends Section 2.10 of the Criminal Procedure Law by adding a new subdivision 85 to allow employees of the Village of Palmyra, pursu- ant to their special duties serving as bailiffs, provided, however, that nothing shall be deemed to authorize such bailiff to carry, possess, repair or dispose of a firearm unless the appropriate license has been issued pursuant to Section 400.00 of the Penal Law or to authorize such officer to carry or possess a firearm except while on duty.

HELMING -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to granting bailiffs in the village of Palmyra in Wayne county peace officer status THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 85 to read as follows: 85. PERSONS EMPLOYED BY THE VILLAGE OF PALMYRA IN WAYNE COUNTY AS BAILIFFS; PROVIDED, HOWEVER THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH BAILIFF TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09524-01-9
