CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services AN ACT to amend part C of chapter 60 of the laws of 2014, amending the social services law and other laws relating to eliminating prescriber prevails for brand name drugs with generic equivalents, in relation to the establishment of a developmental disability clinician advisory group by the commissioner of health THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 18 of part C of chapter 60 of the laws of 2014, amending the social services law and other laws relating to eliminating prescriber prevails for brand name drugs with generic equivalents, is amended to read as follows: § 18. The commissioner of health [is authorized to] SHALL establish a DEVELOPMENTAL disability clinician advisory group of experienced clini- cians and clinic administrators who have an understanding of the compre- hensive needs of people with DEVELOPMENTAL disabilities. Such group shall provide the commissioner and the department of health with infor- mation and data on the effect of policies, including proposed regu- lations or statutes, and of fiscal proposals, including rate setting and appropriations, on the delivery of supports and services for individuals with DEVELOPMENTAL disabilities including but not limited to the role of specialty services. SUCH GROUP SHALL CONSIST OF THE FOLLOWING PERSONS OR THEIR DESIGNEES: THE COMMISSIONER OF THE OFFICE FOR PEOPLE WITH DEVELOP- MENTAL DISABILITIES, THE COMMISSIONER OF THE DEPARTMENT OF HEALTH, THREE INDIVIDUALS APPOINTED BY THE GOVERNOR, TWO INDIVIDUALS EACH BY THE TEMPORARY PRESIDENT OF THE SENATE AND BY THE SPEAKER OF THE ASSEMBLY. THE MEMBERS OF THE GROUP SHALL BE APPOINTED FOR A TERM OF TWO YEARS AND SHALL MEET AT LEAST THREE TIMES IN EACH FULL CALENDAR YEAR DURING THE FIRST TWO YEARS AND ADDITIONALLY UPON THE REQUEST OF THE COMMISSIONER OF THE DEPARTMENT OF HEALTH. THE MEMBERS OF THE GROUP SHALL RECEIVE NO EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
