 AN ACT to amend the real property tax law, in relation to providing that
   state lands within the Eastport-South Manor  Central  School  District
   are subject to taxation for school purposes
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraphs (e) and (f) of subdivision 1 of section  536  of
 the real property tax law, paragraph (e) as amended by section 4 of part
 CC  of  chapter  58  of  the  laws of 2018 and paragraph (f) as added by
 section 1 of part W of chapter 62 of the laws of 2006,  are  amended  to
 read as follows:
   (e) Lands owned by the state, within the core preservation area of the
 Central Pine Barrens area as described and bounded by subdivision eleven
 of section 57-0107 of the environmental conservation law, situate in the
 following school districts:

 the  Central  Pine  Barrens area as described and bounded by [paragraph]
 SUBDIVISION eleven of section 57-0107 of the environmental  conservation
 law, situate in the Riverhead central school district within the town of
 Riverhead, county of Suffolk AND THE EASTPORT-SOUTH MANOR CENTRAL SCHOOL
 DISTRICT  WITHIN  THE  TOWNS  OF  BROOKHAVEN  AND SOUTHAMPTON, COUNTY OF
 SUFFOLK, where the title holder is listed as the "State of New York" [on
 the town of Riverhead's assessment roll as of March sixteenth, two thou-
 sand six].
   § 2. This act shall take effect on the first of April next  succeeding
 the date on which it shall have become a law.

TITLE OF BILL:  An act to amend the real property tax law, in relation
to providing that state lands within the Eastport-South Manor Central
School District are subject to taxation for school purposes

 
PURPOSE:

To provide that state lands within the Eastport-South Manor Central
School District are subject to taxation for school purposes

 
SUMMARY OF PROVISIONS:

Amends paragraphs (e) of subdivision one of Section 536 of the Real
Property Tax Law to provide that state lands within the Eastport-South
Manor Central School District are subject to taxation for school
purposes

 
JUSTIFICATION:

The Eastport-South Manor (ESM) School District was formed in 2000 upon
the merger of two local districts, Eastport Union Free School District
(UFSD) in Eastport, and South Manor UFSD in Manorville. Prior to the
merger, the Eastport Union Free School District was receiving payments
for state-owned lands within the district that were located within the
core preservation area of the Central Pine Barrens. Because these
payments ceased after the merger, this legislation is necessary to
change the name of the school district eligible for these payments from
Eastport Union Free School District to the Eastport-South Manor Central
School District in order for the payments to resume.

ESM is currently the most fiscally distressed school district on Long
Island and is facing a significant budgetary deficit. Restoration of
these payments would help in on-going efforts to return the district to
fiscal stability.
