TITLE OF BILL:  An act to amend chapter 192 of the laws of 2011,
relating to authorizing certain health care professionals licensed to
practice in other jurisdictions to practice in this state in connection
with an event sanctioned by New York Road Runners, in relation to
including the World Triathlon Corporation and extending the provisions
thereof

 
PURPOSE:

To authorize licensed health care professionals from other jurisdictions
to practice in New York State for events sanctioned by either the New
York Road Runners or World Triathlon Corporation.

 
SUMMARY OF PROVISIONS:

Section 1 of the bill allows any person who is licensed to practice as a
physician, physician's assistant, massage therapist, physical therapist,
chiropractor, dentist, optometrist, nurse, nurse practitioner, emergency

medical technician, certified athletic trainer or podiatrist in another
state or territory, who is in good standing in such state or territory,
and who has been appointed by either the New York Road Runners or World
Triathlon Corporation to provide services to athletes and team personnel
at events sanctioned by the New York Road Runners or World Triathlon
Corporation between January 2019 and December 31, 2025.

Section 2 of the bill provides the effective date.

 
JUSTIFICATION:

Each year the State of New York hosts events sanctioned by the New York
Road Runners and the World Triathlon Corporation including Ironman Lake
Placid, and the New York City Marathon.

These events are physically taxing, and each year thousands of athletes
participate. The health and safety of the participants are crucial, and
there are not enough health care professionals available, within the
State, to meet the needs of participants in certain major events. For
these reasons, licensed health care professionals from other states are
necessary.

Legislation is enacted on a yearly basis in order to ensure that
athletes and team personnel are provided professional services from
those licensed in other jurisdictions. This bill would allow these types
of services to continue to be provided at sanctioned events by combining
exemptions into a more useful and long lasting statute. It ensures the
necessary legal authority will be available in a timely manner and not
depend on legislative action each year.

 AN ACT to amend chapter 192 of the laws of 2011, relating to authorizing
   certain health care professionals licensed to practice in other juris-
   dictions to practice in this state in connection with an  event  sanc-
   tioned  by  New  York Road Runners, in relation to including the World
   Triathlon Corporation and extending the provisions thereof
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Chapter  192 of the laws of 2011, relating to authorizing
 certain health care professionals licensed to practice in  other  juris-
 dictions  to  practice  in  this state in connection with an event sanc-
 tioned by New York Road Runners, as amended by chapter 69 of the laws of
 2018, is amended to read as follows:
   Section 1. Notwithstanding any  inconsistent  provision  of  law,  any
 person  who  is licensed to practice as a physician, physician's assist-
 ant, massage therapist, physical therapist, chiropractor, dentist, opto-
 metrist, nurse, nurse practitioner, EMERGENCY MEDICAL TECHNICIAN, certi-
 fied athletic trainer or podiatrist in another state or  territory,  who
 is  in  good  standing  in  such  state  or  territory  and who has been
 appointed by the New York Road Runners OR WORLD TRIATHLON CORPORATION to
 provide professional services at an event in this  state  sanctioned  by
 the  New  York  Road Runners OR WORLD TRIATHLON CORPORATION, may provide
 such professional services to athletes and team personnel registered  to
 train  at  a location in this state or registered to compete in an event
 conducted under the sanction of the  New  York  Road  Runners  OR  WORLD
 TRIATHLON CORPORATION in the state without first being licensed pursuant
 to  the  provisions of title 8 of the education law. Such services shall
 be provided only four days before through one  day  after  each  of  the
 [following events:

   a. the Staten Island half marathon scheduled to be held on October 14,
 2018;
   b.  the  New  York  city  marathon scheduled to be held on November 4,
 2018;
   c. the Brooklyn half marathon scheduled to be held on May 19, 2018;
   d. the Bronx half marathon scheduled to be held on September 30, 2018;
   e. the Queens 10k scheduled to be held on June 16, 2018; and
   f. the New York city half marathon scheduled to be held on  March  18,
 2018]  EVENTS  SANCTIONED  BY  EITHER THE NEW YORK ROAD RUNNERS OR WORLD
 TRIATHLON CORPORATION SCHEDULED TO BE HELD BETWEEN JANUARY 1,  2019  AND
 DECEMBER 31, 2025.
   §  2.  This  act shall take effect immediately and shall expire and be
 deemed repealed [January 31, 2019] DECEMBER 31, 2025.
   § 2. This act shall take effect immediately and  shall  be  deemed  to
 have  been  in  full  force  and  effect  on and after January 31, 2019;
 provided that the amendments to section 1 of chapter 192 of the laws  of
 2011,  made  by section one of this act, shall not affect the expiration
 of such section and shall be deemed repealed therewith.

 such section and shall be deemed repealed therewith.
