TITLE OF BILL:  An act to amend the public health law, in relation to
requiring the commissioner of health to develop guidelines for the
prescribing of opioid antagonists

 
PURPOSE OR GENERAL IDEA OF BILL:

To require the commissioner of health to develop guidelines for medical
professionals regarding the co-prescribing of opioid antagonists (nalox-
one) along with opioid medications.

 
SUMMARY OF SPECIFIC PROVISIONS::

Section one directs the Commissioner of Health to adopt guidelines for
the prescribing of opioid antagonists, applicable to all licensed health
care providers who are authorized to prescribe an opioid analgesic. The
guidelines are to specifically address: prescribing an opioid antagonist
(naloxone) to someone to whom an opioid medication is also prescribed;
and identifying patients at risk of an opioid-related drug overdose and

prescribing an opioid antagonist to that person or to a person in a
position to administer the opioid antagonist to the patient.

In developing the guidelines, the Commissioner is directed to consult
with the State Board of Pharmacy and utilize materials from the
Substance Abuse and Mental Health Services Administration, part of the
US Department of Health & Human Services, as well as publications from
the medical profession.

Section two establishes the effective date.

 
JUSTIFICATION::

The federal Substance Abuse and Mental Health Service Administration
recommends that naloxone be prescribed along with and opioid
prescriptions for certain individuals who may be at high risk of opioid
overdose.

Eleven states have co-prescribing guidelines. A wide range of profes-
sional health organizations, including the American Medical Association,
the World Health Organization and the Centers for Disease Prevention &
Control, supports the co-prescribing of naloxone to at-risk patients.

 AN  ACT  to  amend  the  public health law, in relation to requiring the
   commissioner of health to develop guidelines for  the  prescribing  of
   opioid antagonists

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 3346 to read as follows:
   §  3346. GUIDELINES FOR THE PRESCRIBING OF OPIOID ANTAGONISTS. 1.  THE
 COMMISSIONER SHALL ADOPT GUIDELINES FOR THE PRESCRIBING OF OPIOID ANTAG-
 ONISTS THAT ARE APPLICABLE TO ALL LICENSED HEALTH CARE PROVIDERS IN  THE
 STATE  WHO  ARE AUTHORIZED TO PRESCRIBE AN OPIOID ANALGESIC. SUCH GUIDE-
 LINES MUST ADDRESS:
   (A) PRESCRIBING AN OPIOID ANTAGONIST TO A PATIENT TO  WHOM  AN  OPIOID
 MEDICATION IS ALSO PRESCRIBED; AND
   (B)  IDENTIFYING  PATIENTS  AT RISK OF AN OPIOID-RELATED DRUG OVERDOSE
 AND PRESCRIBING AN OPIOID ANTAGONIST TO THAT PATIENT OR TO A PERSON IN A
 POSITION TO ADMINISTER THE OPIOID ANTAGONIST TO THAT PATIENT.
   2. IN ADOPTING GUIDELINES UNDER THIS SECTION, THE  COMMISSIONER  SHALL
 CONSULT  WITH THE STATE BOARD OF PHARMACY AS WELL AS MATERIALS PUBLISHED
 BY, BUT NOT LIMITED TO, THE SUBSTANCE ABUSE AND MENTAL  HEALTH  SERVICES
 ADMINISTRATION  OF  THE  UNITED  STATES  DEPARTMENT  OF HEALTH AND HUMAN
 SERVICES AND OTHER APPROPRIATE  MATERIALS,  INCLUDING  MEDICAL  JOURNALS
 SUBJECT  TO PEER REVIEW AND PUBLICATIONS BY MEDICAL PROFESSIONAL ASSOCI-
 ATIONS.
   3. THE COMMISSIONER IS AUTHORIZED TO PROMULGATE RULES AND  REGULATIONS
 NECESSARY FOR THE IMPLEMENTATION OF THIS SECTION.
   § 2. This act shall take effect on the one hundred eightieth day after
 it shall have become a law.  Effective immediately, the addition, amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such effective date.
