BILL NUMBER: S5713 SPONSOR: PERSAUD TITLE OF BILL: An act to amend the social services law, in relation to state supplement payments and personal needs allowance for eligible individuals receiving enhanced residential care PURPOSE OR GENERAL IDEA OF BILL: To increase the personal needs allowance provided to residents in adult care facilities to improve the quality of life of these vulnerable indi- viduals SUMMARY OF PROVISIONS: Section 1 of the bill amends subdivision 1 of Social Services Law § 131-0 to increase the monthly personal needs allowance to $300 over a five year period. PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services AN ACT to amend the social services law, in relation to state supplement payments and personal needs allowance for eligible individuals receiv- ing enhanced residential care THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 1 of section 131-o of the social services law, as amended by section 1 of part L of chapter 56 of the laws of 2019, is amended to read as follows: (c) in the case of each individual receiving enhanced residential care, an amount equal to at least: (I) $204.00 for each month beginning on or after January first, two thousand nineteen; (II) $223.00 FOR EACH MONTH BEGINNING ON OR AFTER APRIL FIRST, TWO THOUSAND TWENTY; (III) $243.00 FOR EACH MONTH BEGINNING ON OR AFTER JANUARY FIRST, TWO THOUSAND TWENTY-ONE; (IV) $262.00 FOR EACH MONTH BEGINNING ON OR AFTER JANUARY FIRST, TWO THOUSAND TWENTY-TWO; (V) $281.00 FOR EACH MONTH BEGINNING ON OR AFTER JANUARY FIRST, TWO THOUSAND TWENTY-THREE; AND (VI) $300.00 FOR EACH MONTH BEGINNING ON OR AFTER JANUARY FIRST, TWO THOUSAND TWENTY-FOUR. § 2. Paragraph (e) of subdivision 2 of section 209 of the social services law, as amended by section 2 of part L of chapter 56 of the laws of 2019, is amended to read as follows: (e) [On and after] (I)(1) FROM January first, two thousand nineteen TO MARCH THIRTY-FIRST, TWO THOUSAND TWENTY, [(i)] for an eligible individ- ual receiving enhanced residential care, $1,465.00; and [(ii)] (2) for an eligible couple receiving enhanced residential care, two times the EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
