BILL NUMBER: S5759 SPONSOR: BRESLIN TITLE OF BILL: An act to amend the civil service law, in relation to ensuring identical health benefits for public retirees PURPOSE OR GENERAL IDEA OF BILL: To ensure that no public retiree loses health benefits when they enroll in Medicare SUMMARY OF SPECIFIC PROVISIONS: This legislation amends Section 161 of the civil service law by adding a new subdivision 4. JUSTIFICATION: Public retirees are required to enroll in Medicare when they become eligible, which saves the State money when Medicare becomes the primary

BRESLIN -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to ensuring identical health benefits for public retirees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 161 of the civil service law is amended by adding a new subdivision 4 to read as follows: 4. THERE SHALL BE NO REDUCTION OF BENEFITS PROVIDED TO RETIRED EMPLOY- EES UNDER SUCH HEALTH BENEFIT PLAN AT THE TIME SUCH EMPLOYEE ENROLLS IN MEDICARE, AS MAY BE REQUIRED FOR CONTINUED ELIGIBILITY; PROVIDED, HOWEV- ER, RETIREE BENEFITS UNDER SUCH HEALTH BENEFIT PLAN MAY BE COORDINATED WITH AND TREATED AS SECONDARY INSURANCE TO MEDICARE. § 2.
