 Introduced  by  Sen. SKOUFIS -- read twice and ordered printed, and when
   printed to be committed to the Committee on Rules
 
 AN ACT to amend the social services law and the public  health  law,  in
   relation to providing residential and day services to certain individ-
   uals  with a developmental disability; and establishing rates for such
   services

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision 3 of section 365-a of the social services law
 is amended by adding a new paragraph (e) to read as follows:
   (E) SERVICES, INCLUDING RESIDENTIAL AND  DAY  SERVICES,  FOR  ELIGIBLE
 INDIVIDUALS  WITH  A  DEVELOPMENTAL DISABILITY PROVIDED BY AN INTEGRATED
 RESIDENTIAL COMMUNITY PROGRAM CERTIFIED BY THE  OFFICE  OF  PEOPLE  WITH
 DEVELOPMENTAL  DISABILITIES  AS  A RESIDENTIAL PROGRAM AND RECOGNIZED BY
 THE SAME OFFICE AS A SERVICE DELIVERY ALTERNATIVE.
   § 2. Subdivision 6 of section 3614 of the public health law is amended
 by adding a new paragraph (d) to read as follows:
   (D) THE COMMISSIONER SHALL ESTABLISH RATES  OF  PAYMENT  FOR  SERVICES
 PROVIDED  BY  A  LONG  TERM  CARE  COMMUNITY ESTABLISHED PURSUANT TO THE
 PROVISIONS OF CHAPTER FIVE HUNDRED NINETY-FOUR OF THE LAWS OF TWO  THOU-
 SAND  ELEVEN.  SUCH RATES OF PAYMENT SHALL REFLECT COSTS ASSOCIATED WITH
 INCREASED STAFFING  RATIOS  NECESSARY  FOR  THE  PROVISION  OF  PROGRAM,
 SERVICES AND CARE TO RESIDENTS OF SUCH A COMMUNITY WITH INTELLECTUAL AND
 DEVELOPMENTAL DISABILITIES.
   §  3. This act shall take effect on the first of January next succeed-
 ing the date on which it shall have become a law.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 3 of section 365-a of the social  services  law
