BILL NUMBER: S6622 SPONSOR: STAVISKY TITLE OF BILL: An act to amend the education law, in relation to background checks of physicians PURPOSE OR GENERAL IDEA OF BILL: To amend the education law to require all physicians to undergo back- ground checks as a condition of initial licensure. SUMMARY OF PROVISIONS: Section 1 amends section 6524 of the education law to provide that any individual seeking a license to practice medicine in New York must submit to and pass a full background check to determine board certif- ications, education and any actions against the individual including, but not limited to, actions for professional misconduct. Section 2 provides the effective date.

STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to background checks of physicians THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 6524 of the education law is amended by adding a new subdivision 12 to read as follows: (12) CRIMINAL BACKGROUND CHECKS: SUBMIT TO AND PASS A FULL BACKGROUND CHECK TO DETERMINE SUCH PHYSICIAN'S BOARD CERTIFICATIONS, EDUCATION, AND ANY ACTIONS AGAINST SUCH PHYSICIAN INCLUDING, BUT NOT LIMITED TO, ACTIONS FOR PROFESSIONAL MISCONDUCT. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11989-02-9
