PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to prevent drivers from occupying the left
lane of an interstate highway for reasons other than passing or overtak-
ing other vehicles.
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 amends Section 1122 of the vehicle and traffic law by prevent-
ing a vehicle from being driven in the passing lane of an interstate
highway without passing or overtaking a vehicle for more than one and
one-half miles.
Section 2 marks the effective date.
JUSTIFICATION:
"Coasting" in the passing lane along an interstate highway poses a safe-

AN ACT to amend the vehicle and traffic law, in relation to restricting
driving in a passing lane without overtaking or passing a vehicle
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 1122 of the vehicle and traffic law is amended by
adding a new subdivision (c) to read as follows:
(C) WHEN DRIVING ON AN INTERSTATE HIGHWAY, NO MOTOR VEHICLE SHALL
DRIVE FOR MORE THAN ONE AND ONE-HALF MILES IN A PASSING LANE IF SUCH
VEHICLE IS NOT OVERTAKING OR PASSING A VEHICLE PURSUANT TO THIS SECTION.
§ 2. This act shall take effect immediately.

AN ACT to amend the vehicle and traffic law, in relation to restricting
driving in a passing lane without overtaking or passing a vehicle
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. This act shall be known and may be cited as the "failure to
pass act".
§ 2. Section 1122 of the vehicle and traffic law is amended by adding
a new subdivision (c) to read as follows:
(C) WHEN DRIVING ON AN INTERSTATE HIGHWAY, NO MOTOR VEHICLE SHALL
DRIVE FOR MORE THAN ONE AND ONE-HALF MILES IN A PASSING LANE IF SUCH
VEHICLE IS NOT OVERTAKING OR PASSING A VEHICLE PURSUANT TO THIS SECTION.
NOTWITHSTANDING 15 NYCRR PART 131 OR ANY OTHER LAW, RULE, OR REGULATION
TO THE CONTRARY, A VIOLATION OF THIS SUBDIVISION SHALL NOT CONSTITUTE A
LANE VIOLATION IN ACCORDANCE WITH THE REGULATORY AUTHORITY OF THE
COMMISSIONER. A VIOLATION OF THIS SUBDIVISION SHALL BE PUNISHABLE BY A
FINE OF FIFTY DOLLARS FOR THE FIRST OFFENSE AND BY A FINE OF ONE HUNDRED
DOLLARS FOR EACH SUBSEQUENT OFFENSE.
§ 3. This act shall take effect immediately.
