BILL NUMBER: S7613 SPONSOR: MAY TITLE OF BILL: An act to amend the executive law, in relation to establishing a work- place sexual harassment, harassment, and discrimination hotline PURPOSE: This bill will put in place a single hotline to report workplace sexual harassment, harassment, and discrimination. This legislation will also establish cooperation between the Division of Human Rights and the Department of Labor to increase awareness of the hotline. SUMMARY OF PROVISIONS: Executive Law is amended by adding a new section 296-e that creates technical definitions of terms used in the proposed legislation, estab- lishes a single hotline to be developed by the NYS Division of Human Rights and the NYS Department of Labor (DOL) for filing complaints of

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the executive law, in relation to establishing a work- place sexual harassment, harassment, and discrimination hotline THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 296-e to read as follows: § 296-E. WORKPLACE SEXUAL HARASSMENT, HARASSMENT, AND DISCRIMINATION HOTLINE. 1. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) "SEXUAL HARASSMENT, HARASSMENT, OR DISCRIMINATION IN THE WORK- PLACE" SHALL INCLUDE ANY UNLAWFUL DISCRIMINATORY PRACTICES SET FORTH IN SUBDIVISION ONE OF SECTION TWO HUNDRED NINETY-SIX OF THIS ARTICLE. (B) "THE HOTLINE" SHALL MEAN THE TOLL FREE NUMBER DIRECTED TO BE ESTABLISHED BY SUBDIVISION TWO OF THIS SECTION. 2. THE DIVISION, IN COOPERATION WITH THE DEPARTMENT OF LABOR, SHALL ESTABLISH A SINGLE TOLL FREE NUMBER, WHICH A RESIDENT OF THIS STATE MAY USE TO CONTACT A DESIGNEE APPOINTED BY THE DIVISION, IN COOPERATION WITH THE DEPARTMENT OF LABOR, TO SUBMIT A COMPLAINT REGARDING SEXUAL HARASS- MENT, HARASSMENT, OR DISCRIMINATION IN THE WORKPLACE. 3. THE COMMISSIONER, IN COOPERATION WITH THE COMMISSIONER OF LABOR, SHALL PROMULGATE ANY RULES AND/OR REGULATIONS NECESSARY FOR THE IMPLE- MENTATION OF THE HOTLINE. 4. TO INCREASE AWARENESS OF THE HOTLINE, THE DIVISION AND THE DEPART- MENT OF LABOR SHALL EACH PROMINENTLY PROMOTE THE HOTLINE ON THEIR INTER- NET WEBSITES AND SHALL, IN COOPERATION, DEVELOP PUBLIC SERVICE ANNOUNCE- MENTS TO BE DISTRIBUTED TO COMMERCIAL RADIO AND TELEVISION STATIONS, PUBLIC ACCESS TELEVISION STATIONS, AND PRINT MEDIA THROUGHOUT THE STATE, INFORMING THE PUBLIC OF THE HOTLINE. SUCH WEBSITE PROMOTIONS AND PUBLIC SERVICE ANNOUNCEMENTS SHALL BE DISTRIBUTED IN ENGLISH AND SUCH OTHER LANGUAGES AS THE COMMISSIONER AND THE COMMISSIONER OF LABOR SHALL DEEM APPROPRIATE. 5. THE HOTLINE SHALL BE OPERATIONAL NO LATER THAN DECEMBER FIRST, TWO THOUSAND TWENTY.
