 Introduced  by  Sen.  BIAGGI -- read twice and ordered printed, and when
   printed to be committed to the Committee on Consumer Protection
 
 AN ACT to amend the general business law, in relation to prohibiting the
   advertisement of firearms as combat weapons
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The general business law is amended by adding a new section
 396-eee to read as follows:
   §  396-EEE. PROHIBITS THE ADVERTISEMENT OF FIREARMS AS COMBAT WEAPONS.
 1.  NO PERSON, FIRM OR CORPORATION ENGAGED IN  THE  RETAIL  BUSINESS  OF
 SELLING  RIFLES,  SHOTGUNS  OR  FIREARMS,  AS  SUCH TERMS ARE DEFINED IN
 SECTION 265.00 OF THE PENAL LAW, SHALL ADVERTISE SUCH  RIFLES,  SHOTGUNS
 OR  FIREARMS  TO THE GENERAL PUBLIC BY MEANS OF ADVERTISEMENTS IN PUBLIC
 NEWSPAPERS, MAGAZINES, BY RADIO OR TELEVISION, OR  BY  ELECTRONIC  MEDIA
 DISPLAY ADVERTISEMENTS, FOR THE PURPOSE OF OFFENSIVE ASSAULT OR HOMICIDE
 OR OTHER RELATED OFFENSES PURSUANT TO ARTICLE ONE HUNDRED TWENTY-FIVE OF
 THE PENAL LAW.
   2. FOR THE PURPOSES OF THIS SECTION, THE ADVERTISEMENT OF SUCH RIFLES,
 SHOTGUNS  OR  FIREARMS FOR THE PURPOSES OF RECREATION, HUNTING, SELF-DE-
 FENSE OR OTHER LEGAL USES OF SUCH FIREARMS SHALL BE EXEMPT.
   3. FOR THE PURPOSES OF THIS  SECTION,  THE  TERM  "OFFENSIVE  ASSAULT"
 MEANS INTENTIONALLY INITIATING AND INFLICTING PHYSICAL HARM ONTO OTHERS.
   § 2. This act shall take effect immediately.
