BILL NUMBER: S8638 SPONSOR: KAMINSKY TITLE OF BILL: An act in relation to defining residential construction as an essential business SUMMARY OF PROVISIONS: Section 1. Provides that notwithstanding any other law during the period of executive order 202 of 2020 essential business would include residen- tial construction not in excess of three stories, notwithstanding wheth- er it is defined as affordable. JUSTIFICATION: Construction was included as an essential business in Executive Order 202.6. Residential home builders thus continued to work on projects. However, issues were soon reported around high rise construction in New York City where employees expressed concerns about social distancing and

KAMINSKY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT in relation to defining residential construction as an essential business THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, rule or regu- lation during the period of the COVID-19 state disaster emergency as declared pursuant to executive order 202 of 2020, and extensions there- of, and article 2-B of the executive law, essential business, as provided for in executive order 202.6, shall include residential construction not in excess of three stories, notwithstanding whether such construction is defined as affordable. § 2.
