TITLE OF BILL:

An act to amend the state finance law, in relation to creating the
public/private security camera fund; and making an appropriation there-
for

 
SUMMARY OF PROVISIONS:

Section 1 creates a new section 99-ii of the state finance law, which
authorizes a public/private security camera fund and provides for how
the fund shall be operated. This section provides that the fund shall
include revenues from the abandoned property fund and any other funding
source pursuant to law as well as any individual or private contrib-
utions made to it. This section further provides that $10,000,000 shall
be allocated to the fund for use in providing video surveillance systems
for businesses across the State and provides factors for consideration
for which businesses will receive funds.  Any business that receives
funds shall provide law enforcement with access to their video surveil-
lance system.

Section 2 appropriates $10,000,000 in support of the public/private
security camera fund.

Section 3 sets forth the effective date.

 
JUSTIFICATION:

Video surveillance equipment from businesses close to crime scenes -
even businesses unaffected by the crime - can often be critical in
catching criminal perpetrators and preventing the commission of further
crimes. A 2011 study sponsored by the United States Department of
Justice concluded that in many contexts video surveillance is a "useful
tool for preventing crimes, aiding in arrests, and supporting investi-
gations and prosecutions" and "actively monitored, have a cost-benefi-
cial impact on crime" with no significant evidence of any negative
effects on neighborhoods they're placed in. Clearly, it should be the
public policy of New York State to encourage the use of security cameras
and expand their use as much as possible.

This bill is intended to combat crime and ensure safe neighborhoods and
businesses by expanding the use of security cameras and creating a part-
nership between businesses and law enforcement. It creates a
public/private security camera fund under the joint custody of the Comp-
troller and Tax and Finance Commissioner, which will provide grants for
video surveillance system for businesses across the State which law
enforcement shall be given access to. The grants awarded by this fund
would be given with priority for small businesses in areas with high
crime rates, and the grants would be limited to one thousand dollars. By
enacting this bill, New York State can prioritize the use of security
cameras by partnering with businesses, ensuring safe localities and a
safe State.

 AN ACT to amend the state finance  law,  in  relation  to  creating  the
   public/private  security  camera  fund;  and  making  an appropriation
   therefor
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  state finance law is amended by adding a new section
 99-ii to read as follows:
   § 99-II. PUBLIC/PRIVATE SECURITY  CAMERA  FUND.  1.  THERE  IS  HEREBY
 ESTABLISHED  IN  THE  JOINT  CUSTODY  OF  THE  STATE COMPTROLLER AND THE
 COMMISSIONER OF TAXATION AND FINANCE A SPECIAL FUND TO BE KNOWN  AS  THE
 PUBLIC/PRIVATE SECURITY CAMERA FUND.
   2. SUCH FUND SHALL CONSIST OF ALL REVENUES RECEIVED FROM THE ABANDONED
 PROPERTY  FUND PURSUANT TO SECTION NINETY-FIVE OF THIS ARTICLE, FROM THE
 GENERAL FUND, AND FROM ALL OTHER MONEYS CREDITED OR TRANSFERRED  THERETO
 FROM  ANY  OTHER  FUND  OR  SOURCE PURSUANT TO LAW. SUCH FUND SHALL ALSO
 RECEIVE CONTRIBUTIONS FROM PRIVATE INDIVIDUALS, ORGANIZATIONS, OR  OTHER
 PERSONS  TO  FULFILL  THE PURPOSES OF THE PUBLIC/PRIVATE SECURITY CAMERA
 FUND.
   3. THE SUM OF TEN MILLION DOLLARS ANNUALLY SHALL BE  USED  FOR  GRANTS
 RELATED  TO  PROVIDING VIDEO SURVEILLANCE SYSTEMS FOR BUSINESSES OR NOT-
 FOR-PROFIT CORPORATIONS IN HIGH CRIME AREAS OF  THE  STATE.  THE  GRANTS
 SHALL BE DISTRIBUTED PURSUANT TO A PLAN DEVELOPED BY THE COMMISSIONER OF
 CRIMINAL  JUSTICE SERVICES. SUCH PLAN SHALL CONSIDER FACTORS SUCH AS THE
 CRIME RATE IN THE IMMEDIATE VICINITY OF THE BUSINESS  OR  NOT-FOR-PROFIT
 CORPORATION,  WITH PRIORITY GIVEN TO SMALL BUSINESSES AND NOT-FOR-PROFIT
 CORPORATIONS IN AREAS WITH HIGH CRIME RATES, THE NUMBER OF EMPLOYEES  OF
 THE BUSINESS OR NOT-FOR-PROFIT CORPORATION, WITH PRIORITY GIVEN TO SMALL
 BUSINESSES  AND  NOT-FOR-PROFIT CORPORATIONS AND THE PUBLIC SAFETY BENE-
 FITS OF PLACING A VIDEO SURVEILLANCE SYSTEM AT SUCH BUSINESS OR NOT-FOR-
 PROFIT CORPORATION. NO  BUSINESS  OR  NOT-FOR-PROFIT  CORPORATION  SHALL
 RECEIVE MORE THAN ONE THOUSAND DOLLARS IN GRANT MONEY.

   4. UPON THE SHOWING OF GOOD CAUSE, A BUSINESS OR NOT-FOR-PROFIT CORPO-
 RATION  THAT  RECEIVES A GRANT SHALL PROVIDE LAW ENFORCEMENT WITH ACCESS
 TO THEIR VIDEO SURVEILLANCE SYSTEM.
   § 2. The sum of ten million dollars ($10,000,000), is hereby appropri-
 ated  to  the  department  of audit and control out of any moneys in the
 state treasury in the general fund to the credit of  the  public/private
 security  camera  fund, not otherwise appropriated, and made immediately
 available, for the purpose of carrying out the provisions of  this  act.
 Such moneys shall be payable on the audit and warrant of the comptroller
 on  vouchers  certified  or  approved  by  the  commissioner of criminal
 justice services in the manner prescribed by law.
   § 3. This act shall take effect immediately.
