Fall) -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to specifying proce- dures for the closure and/or decertification of diagnostic and treat- ment centers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2828 to read as follows: § 2828. CLOSURE OF DIAGNOSTIC AND TREATMENT CENTERS. 1. IN THE EVENT THAT AN OPERATOR OF A DIAGNOSTIC AND TREATMENT CENTER ORGANIZED UNDER THIS ARTICLE ELECTS TO CLOSE AND TO SURRENDER AN OPERATING CERTIFICATE AND/OR CERTIFICATION AS A DIAGNOSTIC AND TREATMENT CENTER, THE FOLLOWING PROVISIONS SHALL APPLY: (A) THE OPERATOR SHALL NOTIFY THE APPROPRIATE REGIONAL OFFICE OF THE DEPARTMENT IN WRITING PRIOR TO THE ANTICIPATED DATE OF CLOSURE OF THE DIAGNOSTIC AND TREATMENT CENTER AND/OR THE DECERTIFICATION OF SUCH DIAG- NOSTIC AND TREATMENT CENTER. (B) SUCH WRITTEN NOTICE SHALL INCLUDE A PROPOSED PLAN FOR CLOSURE AND/OR DECERTIFICATION. THE PLAN SHALL BE SUBJECT TO THE APPROVAL OF THE COMMISSIONER, SHALL INCLUDE TIMETABLES FOR ALL STEPS ENTAILED IN THE CLOSURE PROCESS AND SHALL DESCRIBE THE PROCEDURES AND ACTIONS THE OPERA- TOR WILL TAKE TO: (I) NOTIFY PATIENTS WHO HAVE VISITED THE DIAGNOSTIC AND TREATMENT CENTER WITHIN THE PAST YEAR OR THE REPRESENTATIVES OF SUCH PATIENTS OF THE CLOSURE, AND/OR DECERTIFICATION; (II) NOTIFY PATIENTS OR THE REPRESENTATIVES OF SUCH PATIENTS OF OTHER DIAGNOSTIC AND TREATMENT CENTERS IN THEIR AREA; AND (III) MAINTAIN COMPLIANCE WITH APPROVED PLAN UNTIL ALL PRIOR PATIENTS HAVE BEEN NOTIFIED PURSUANT TO THIS SUBDIVISION. 2. THE OPERATOR SHALL TAKE NO ACTION TO CLOSE THE DIAGNOSTIC AND TREATMENT CENTER PRIOR TO APPROVAL FROM THE COMMISSIONER OF THE PLAN FOR CLOSURE AND/OR DECERTIFICATION. Fall, Simon, Darling, O'Donnell) -- read once and referred to the Committee on Health -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT in relation to directing the commissioner of health to conduct a study of the delivery of ambulatory care on Staten Island THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. a. The commissioner of health shall conduct a study of the delivery of primary care, urgent care, and commonly used ambulatory health care services on Staten Island, including the current situation and expected trends for the future. Entities to be studied shall include clinics operating within or sponsored by pharmacies and other retail businesses (retail clinics), ambulatory health care offices open for extended hours without an appointment (urgent care centers), and major ambulatory health care practices (whether in one location or multiple locations) whose health care professionals are linked directly or indirectly in an economic relationship, federally qualified health centers, community health centers, general hospital ambulatory care clinics, and other ambulatory care centers. Entities to be studied shall not include ambulatory surgery centers or office-based surgery practices. b. The study shall examine the impact of the respective entities on the delivery, quality, accessibility, and cost of ambulatory health care on Staten Island. The commissioner shall make recommendations to improve the delivery, quality, accessibility, and cost of the full range of ambulatory health care services required by the community. c. During the study the operator of a clinic, urgent care, and/or such major ambulatory health care practice shall give a 30-day notice to the department of health and locally elected officials before a closure, relocation or decertification. d. The commissioner of health shall report and publish on the depart- ment of health's website, and transmit the commissioner's findings and recommendations to the governor, the speaker of the assembly, the minor- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
