S T A T E O F N E W Y O R K ________________________________________________________________________ 7070 2019-2020 Regular Sessions I N A S S E M B L Y April 4, 2019 ___________ Introduced by M. of A. BURKE -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to enacting the "traffic ticket relief act" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Short title. This act shall be known and may be cited as the "traffic ticket relief act". § 2. Section 241 of the vehicle and traffic law is amended by adding a new subdivision 4 to read as follows: 4. FOR ANY FINE IMPOSED ON A PERSON BY A HEARING EXAMINER PURSUANT TO THIS SECTION, THE HEARING EXAMINER MAY REDUCE THE AMOUNT OF SUCH FINE AS A RESULT OF SUCH PERSON'S LACK OF ABILITY TO PAY. THE HEARING EXAMINER MAY REQUEST ANY DOCUMENTATION HE OR SHE BELIEVES NECESSARY TO MAKE SUCH A DETERMINATION. THE HEARING EXAMINER MAY ALSO AUTHORIZE THE PERSON FINED TO PAY SUCH FINE IN INSTALLMENTS TO BE DETERMINED BY THE HEARING EXAMINER. § 3. Section 227 of the vehicle and traffic law is amended by adding a new subdivision 7 to read as follows: 7. FOR ANY FINE IMPOSED ON A PERSON BY A HEARING OFFICER PURSUANT TO THIS SECTION, THE HEARING OFFICER MAY REDUCE THE AMOUNT OF SUCH FINE AS A RESULT OF SUCH PERSON'S LACK OF ABILITY TO PAY. THE HEARING OFFICER MAY REQUEST ANY DOCUMENTATION HE OR SHE BELIEVES NECESSARY TO MAKE SUCH A DETERMINATION.
