RODRIGUEZ -- read once and referred to the Committee on Labor AN ACT to amend the executive law, in relation to the authority of the New York black car operators' injury compensation fund, inc. THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 160-ii of the executive law is amended by adding a new subdivision 5 to read as follows: 5. THE FUND SHALL HAVE THE AUTHORITY TO PROVIDE ADDITIONAL BENEFITS, CONSISTENT WITH ITS PLAN OF OPERATION, FOR ALL BLACK CAR OPERATORS ENTI- TLED THERETO PURSUANT TO THIS CHAPTER, PROVIDED THAT THE FUND SHALL HAVE COMPLIED WITH ALL APPLICABLE STATUTORY AND REGULATORY REQUIREMENTS. THE SURCHARGE AMOUNT NOT RELATED TO PAYMENTS OF WORKERS' COMPENSATION CLAIMS AND THE ADMINISTRATION OF THOSE CLAIMS SHALL BE ONE-HALF OF ONE PERCENT (0.5%). § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13027-01-9
