BILL NUMBER: S4449 SPONSOR: BIAGGI TITLE OF BILL: An act to amend chapter 465 of the laws of 1994, amending chapter 285 of the laws of 1891 relating to charging a fee for admission to the New York Botanical Garden, in relation to making perma- nent certain provisions authorizing the imposition of a required fee; and to repeal section 2 of such chapter 465 of the laws of 1994 relating thereto PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to give the New York Botanical Garden authorization to charge or not charge an admission fee. SUMMARY OF PROVISIONS: Section 1: Amends chapter 465 of the laws of 1994, section 3 and subse- quent extensions, to eliminate the expiration date authorizing the New York Botanical Garden to charge a fee for admission by the general public to help sustain the organization's operations and botanical

BIAGGI -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend chapter 465 of the laws of 1994, amending chapter 285 of the laws of 1891 relating to charging a fee for admission to the New York Botanical Garden, in relation to making permanent certain provisions authorizing the imposition of a required fee; and to repeal section 2 of such chapter 465 of the laws of 1994 relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of chapter 465 of the laws of 1994, amending chapter 285 of the laws of 1891 relating to charging a fee for admission to the New York Botanical Garden, as amended by chapter 120 of the laws of 2014, is amended to read as follows: § 3. This act shall take effect immediately and shall be deemed to have been in full force and effect on and after April 30, 1994[; provided that: (a) the amendment made by section one of this act shall expire and be deemed repealed on May 1, 2020; and (b) section two of this act shall take effect on May 1, 2020]. § 2. Section 2 of chapter 465 of the laws of 1994, amending chapter 285 of the laws of 1891 relating to charging a fee for admission to the New York Botanical Garden, is REPEALED. § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09768-02-9
