BILL NUMBER: S5822 SPONSOR: METZGER TITLE OF BILL: An act to amend the parks, recreation and historic preservation law and the general municipal law, in relation to farmers' markets in state and local parks PURPOSE: The purpose of this legislation is to increase the number of available locations for farmers' markets and increase New Yorker's access to locally grown and produced food. SUMMARY OF PROVISIONS: Section 1 - Amends section 3.09 of the parks, recreation and historic preservation law by adding a new subdivision 24 which permits farmer's markets at state parks provided that the market does not harm the natural environment or integrity of the park. METZGER -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law and the general municipal law, in relation to farmers' markets in state and local parks THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3.09 of the parks, recreation and historic preser- vation law, is amended by adding a new subdivision 24 to read as follows: 24. PERMIT FARMERS' MARKETS WHICH OFFER FOR SALE FARM AND FOOD PRODUCTS, AS SUCH TERMS ARE DEFINED IN SECTION TWO HUNDRED SIXTY OF THE AGRICULTURE AND MARKETS LAW, AT STATE PARKS WHEN SUCH FARMERS' MARKET DOES NOT HARM THE NATURAL ENVIRONMENT OR INTEGRITY OF THE PARK. § 2. Section 72-p of the general municipal law, as added by chapter 506 of the laws of 1989, is amended by adding a new subdivision 4 to read as follows: 4. SUCH MUNICIPAL CORPORATION SHALL PERMIT FARMERS' MARKETS IN ANY PARK OVER WHICH SUCH CORPORATION HAS JURISDICTION; PROVIDED, HOWEVER, THAT SUCH FARMERS' MARKET DOES NOT UNDULY BURDEN NEARBY RESIDENTS OR HINDER THE CHARACTER OR NATURAL ENVIRONMENT OF SUCH PARK. § 3.
