BILL NUMBER: S6285 SPONSOR: RANZENHOFER TITLE OF BILL: An act in relation to authorizing the town of Amherst in the county of Erie to discontinue the use of certain lands as park- lands and to sell such lands and dedicate other lands as parklands PURPOSE OR GENERAL IDEA OF BILL: To authorize the Town of Amherst, located in Erie County, to discontinue the use of certain lands within the Audubon Recreational Complex as parkland and to sell such lands as part of a parkland development project. SUMMARY OF SPECIFIC PROVISIONS: Section 1- authorizes the Town of Amherst to discontinue as parklands and sell certain land as described in Section 3 . RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT in relation to authorizing the town of Amherst in the county of Erie to discontinue the use of certain lands as parklands and to sell such lands and dedicate other lands as parklands THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subject to the provisions of this act, the town of Amherst, county of Erie is hereby authorized to discontinue use of certain park- lands within what is commonly known as the Audubon Recreational Complex more particularly those lands described in section three of this act, and to sell and convey in fee simple for its fair market value and upon such terms and conditions as to the town of Amherst it is deemed appro- priate. § 2. The authorization provided for in section one of this act shall be subject to the requirement that upon alienation of the lands more particularly described in section three of this act, the town of Amherst shall dedicate all proceeds from the sale of said lands for the acquisi- tion of land of equal or greater fair market value that shall be dedi- cated as parkland. In the event any proceeds of the sale of the lands specified in section three shall remain, or if appropriate parcels cannot be identified after a diligent search, the town of Amherst shall only use said proceeds for the capital improvements of existing or future park facilities in the town of Amherst. § 3. The lands referred to in section one of this act are located, bounded and described as follows: ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Amherst, County of Erie, State of New York, being Part of Lots 61, 67 and 73, Township 12, Range 7 of the Holland Land Company's Survey more partic- ularly bounded and described as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. Subject to the provisions of this act, the town of Amherst, in the county of Erie, acting by and through its governing body and upon such terms and conditions as determined by such body, is hereby author- ized to discontinue as parklands and alienate the lands described in section three of this act for the purpose of establishing a privately- developed project to include new recreational facilities, a sports medi- cine complex, and senior housing. § 2. The authorization contained in section one of this act shall take effect only upon the condition that the town of Amherst dedicates an amount equal to or greater than the fair market value of the parklands being discontinued towards the acquisition of new parklands and/or capi- tal improvements to existing park and recreational facilities. § 3. The parklands authorized by section one of this act to be alien- ated are described as follows: ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Amherst, County of Erie and State of New York, being Part of Lots 61, 67 and 73, Township 12, Range 7 of the Holland Land Company's Survey and being further described as follows: Commencing at the southwest corner of said Lot 67, also being the south- east corner of Lot 73; Thence northerly along the east line of said Lot 73, a distance of 922.34 feet to the POINT OF BEGINNING; Thence continu- ing northerly along said east line of Lot 73, a distance of 33.61 feet to a point; Thence westerly at an interior angle of 268° 03' 00", a EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
