BILL NUMBER: S6293 SPONSOR: COMRIE TITLE OF BILL: An act to amend chapter 59 of the laws of 2018, constituting the New York city BQE Design-Build act, in relation to public work authorization and the effectiveness thereof and repealing certain provisions of such chapter relating thereto SUMMARY OF PROVISIONS: This bill expands New York City's express Design Build authorization to fully include: the Department of Design & Construction (DDC), Department of Transportation, Department of Environmental Protection, School Construction Authority, Department of Parks & Recreation (Parks), New York City Housing Authority & The New York City Health & Hospitals Corporation. The authorization applies to any public work undertaken pursuant to a project labor agreement in accordance with Section 222 of the labor law that has an estimated total cost of no less than 10 million dollars, with the exception of Parks and DDC where such threshold is set at no less than 1.2 million dollars.

COMRIE, JACKSON -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend chapter 59 of the laws of 2018, constituting the New York city BQE Design-Build act, in relation to public work authori- zation and the effectiveness thereof and repealing certain provisions of such chapter relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1 of part QQQ of chapter 59 of the laws of 2018, constituting the New York city BQE Design-Build act, is amended to read as follows: Section 1. This act shall be known and may be cited as the "New York city [BQE] Design-Build act". § 2. Section 2 of part QQQ of chapter 59 of the laws of 2018, consti- tuting the New York city BQE Design-Build act, is amended to read as follows: § 2. For the purposes of this act: (a) "Authorized entity" shall mean the New York city department of design and construction, [and] the New York city department of transpor- tation, THE NEW YORK CITY DEPARTMENT OF ENVIRONMENTAL PROTECTION, THE NEW YORK CITY SCHOOL CONSTRUCTION AUTHORITY, THE NEW YORK CITY DEPART- MENT OF PARKS AND RECREATION, THE NEW YORK CITY HEALTH AND HOSPITALS CORPORATION, AND NEW YORK CITY HOUSING AUTHORITY. (b) "Best value" shall mean the basis for awarding contracts for services to a proposer that optimizes quality, cost and efficiency, price and performance criteria, which may include, but is not limited to: (1) The quality of the proposer's performance on previous projects; (2) The timeliness of the proposer's performance on previous projects; (3) The level of customer satisfaction with the proposer's performance on previous projects; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

The authorization applies to any public work undertaken pursuant to a project labor agreement in accordance with Section 222 of the labor law that has an estimated total cost of no less than 10 million dollars, with the exception for certain homeland security, cultural, and housing projects.
