BILL NUMBER: S6412 SPONSOR: KAVANAGH TITLE OF BILL: An act to amend the public housing law, in relation to the powers of the division of housing and community renewal PURPOSE OF THE BILL: This bill would amend the Public Housing Law to allow the Division of Housing and Community Renewal (DHCR), the Housing Finance Agency, and Housing Trust Fund Corporation and its subsidiaries (collectively "HCR") to impose penalties and other remedies necessary to correct violations of laws, regulations, or directives by housing providers that receive financing or other benefits from HCR. This bill is necessary to ensure compliance with the various requirements of affordable housing programs, thereby, providing programmatic efficiencies and best use of HCR's spending. KAVANAGH -- (at request of the New York State Homes and Community Renewal) -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public housing law, in relation to the powers of the division of housing and community renewal THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 14 of the public housing law is amended by adding new subdivision 8 to read as follows: 8. (A) IN ADDITION TO ANY OTHER AUTHORITY OTHERWISE PROVIDED IN LAW, REGULATION OR DIRECTIVE, THE DIVISION OF HOUSING AND COMMUNITY RENEWAL IN COOPERATION WITH THE NEW YORK HOUSING FINANCE AGENCY, AND THE NEW YORK HOUSING TRUST FUND CORPORATION AND ITS SUBSIDIARIES, IN ORDER TO EFFECTUATE COMPLIANCE WITH SUCH LAWS, REGULATIONS, DIRECTIVES, AND AGREEMENTS AND TO ENJOIN FAILURES TO DO THAT WHICH IS REQUIRED BY LAW, REGULATION, AGREEMENTS OR DIRECTIVE, ON BEHALF OF ANY HOUSING PROVIDER, HOUSING COMPANY, HOUSING-PROJECT OR OTHER ENTITY, IS AUTHORIZED TO: (I) ISSUE AND IMPOSE ORDERS, DIRECTIVES AND ASSESS ACTUAL AND PECUNI- ARY PENALTIES, OR OTHER REMEDIES AND RELIEF NECESSARY TO ASSURE COMPLI- ANCE AND PENALIZE NONCOMPLIANCE WITH LAW, REGULATION, DIRECTIVE OR AGREEMENT; AND (II) ESTABLISH THE PROCEDURE FOR THE IMPLEMENTATION OF THE REQUIRE- MENTS OF THIS SUBDIVISION. (B) THE DIVISION OF HOUSING AND COMMUNITY RENEWAL IN COOPERATION WITH THE NEW YORK HOUSING FINANCE AGENCY, AND THE NEW YORK HOUSING TRUST FUND CORPORATION AND ITS SUBSIDIARIES IS AUTHORIZED TO PROMULGATE SUCH REGU- LATIONS AND OTHER RULES AND DIRECTIVES NECESSARY TO EFFECTUATE THIS SUBDIVISION. REGULATIONS, RULES OR DIRECTIVES PROMULGATED BY THE DIVI- SION OF HOUSING AND COMMUNITY RENEWAL, NEW YORK STATE HOUSING FINANCE AGENCY, OR THE HOUSING TRUST FUND CORPORATION AND ITS SUBSIDIARIES, SHALL BE OPERABLE TO ALL SUCH HOUSING PROVIDERS, HOUSING COMPANIES, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
