   printed to be committed to the Committee on Rules
 
 AN ACT to amend the mental hygiene law, in relation to  authorizing  the
   office  of  mental health and the office for people with developmental
   disabilities to provide transitional care for certain persons

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Paragraph  6  of subdivision (a) of section 7.37-a of the
 mental hygiene law is renumbered paragraph 7.
   § 2. Paragraph 5 of subdivision (a) of section 7.37-a  of  the  mental
 hygiene law, as added by chapter 405 of the laws of 1998, is amended and
 a new paragraph 6 is added to read as follows:
   5.  whose  residential  needs  can be met by the facility in which the
 persons resided prior to becoming age twenty-one or becoming  ineligible
 for free educational services; [and]
   6.  WHO WERE DISABLED AND IN NEED OF RESIDENTIAL EDUCATIONAL PLACEMENT
 PRIOR TO BECOMING TWENTY-ONE YEARS OF AGE, PROVIDED THAT SUCH PERSON WAS
 ABANDONED AND THAT SUCH TRANSITIONAL CARE SHALL ONLY BE  PROVIDED  UNTIL
 RESIDENTIAL EDUCATIONAL PLACEMENT IS FOUND FOR SUCH PERSON; AND
   §  3.  Paragraph 6 of subdivision (a) of section 13.37-a of the mental
 hygiene law is renumbered paragraph 7.
   § 4. Paragraph 5 of subdivision (a) of section 13.37-a of  the  mental
 hygiene  law,  as amended by chapter 106 of the laws of 2015, is amended
 and a new paragraph 6 is added to read as follows:
   5. whose residential needs can be met by the  facility  in  which  the
