2019-S6959 (ACTIVE) - Summary
Authorizes the New York black car operators' injury compensation fund, inc. to provide additional health benefits, consistent with its plan of operation, for all black car operators entitled thereto pursuant to this chapter, provided that the fund shall have complied with all applicable statutory and regulatory requirements; and provides for the expiration and repeal of a chapter of the laws of 2019 related thereto.

BILL NUMBER: S6959 SPONSOR: SAVINO TITLE OF BILL: An act to amend the executive law, in relation to the authority of the New York black car operators' injury compensation fund, inc.; and to amend a chapter of the laws of 2019, amending the executive law relating to the authority of the New York black car operators' inju- ry compensation fund, inc., as proposed in legislative bills numbers S. 6239-A and A. 8129-A, in relation to the effectiveness thereof PURPOSE OR IDEA OF GENERAL BILL: Makes various amendments to a chapter from 2019. SUMMARY OF SPECIFIC PROVISIONS: This legislation clarifies the revenue dedication language from the original chapter from 2019 to provide additional discretion. The legis- lation also sets a three-year sunset on the chapter from 2019.

SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the executive law, in relation to the authority of the New York black car operators' injury compensation fund, inc.; and to amend a chapter of the laws of 2019, amending the executive law relat- ing to the authority of the New York black car operators' injury compensation fund, inc., as proposed in legislative bills numbers S. 6239-A and A. 8129-A, in relation to the effectiveness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5 of section 160-ii of the executive law, as added by a chapter of the laws of 2019, amending the executive law relating to the authority of the New York black car operators' injury compensation fund, inc., as proposed in legislative bills numbers S. 6239-A and A. 8129-A, is amended to read as follows: 5. The fund shall have the authority to provide additional health benefits, consistent with its plan of operation, for all black car oper- ators entitled thereto pursuant to this chapter, provided that the fund shall have complied with all applicable statutory and regulatory requirements. The surcharge amount not related to payments of workers' compensation claims and the administration of those claims shall be UP TO one-half of one percent (0.5%). § 2. Section 2 of a chapter of the laws of 2019, amending the execu- tive law relating to the authority of the New York black car operators' injury compensation fund, inc., as proposed in legislative bills numbers S. 6239-A and A. 8129-A, is amended to read as follows: § 2. This act shall take effect immediately AND SHALL EXPIRE AND BE DEEMED REPEALED THREE YEARS AFTER SUCH DATE. § 3. This act shall take effect immediately, provided, however, that section one of this act shall take effect on the same date and in the same manner as a chapter of the laws of 2019, amending the executive law relating to the authority of the New York black car operators' injury compensation fund, inc., as proposed in legislative bills numbers S. 6239-A and A. 8129-A, takes effect.
