BILL NUMBER: S6963 SPONSOR: SERRANO TITLE OF BILL: An act to amend chapter 383 of the laws of 2019 amending the public authorities law relating to the Roosevelt Island operating corporation, in relation to the continuity of the Roosevelt Island operating corpo- ration PURPOSE: This is a chapter amendment that makes changes to provisions of L.2019, c.383. SUMMARY OF PROVISIONS: This legislation amends the underlying chapter by adding language to ensure Roosevelt Island operating corporation in the new statute is a continuation of the Roosevelt Island operating corporation, as it was constituted preceding the effective date of the underlying chapter.

SERRANO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend chapter 383 of the laws of 2019 amending the public authorities law relating to the Roosevelt Island operating corpo- ration, in relation to the continuity of the Roosevelt Island operat- ing corporation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of chapter 383 of the laws of 2019 amending the public authorities law relating to the Roosevelt Island operating corpo- ration is amended to read as follows: § 3. TITLE 35 OF ARTICLE 8 OF THE PUBLIC AUTHORITIES LAW CONSTITUTING THE ROOSEVELT ISLAND OPERATING CORPORATION CREATED BY THIS ACT SHALL BE DEEMED FOR ALL PURPOSES TO BE A CONTINUATION OF THE ROOSEVELT ISLAND OPERATING CORPORATION AS IT WAS CONSTITUTED IMMEDIATELY PRECEDING THE EFFECTIVE DATE OF THIS ACT AND SHALL NOT BE CONSTRUED AS A NEWLY CREATED CORPORATION. ALL MEMBERS OF THE ROOSEVELT ISLAND OPERATING CORPORATION BOARD OF DIRECTORS APPOINTED TO THE BOARD OF THE CORPORATION AS SUCH CORPORATION WAS CONSTITUTED IMMEDIATELY PRECEDING THE EFFECTIVE DATE OF THIS ACT SHALL CONTINUE IN OFFICE UNTIL THE EXPIRATION OF THEIR TERMS AND UNTIL THEIR SUCCESSORS ARE APPOINTED AND HAVE QUALIFIED. ALL UNEX- PENDED BALANCES OF APPROPRIATIONS OF MONIES HERETOBEFORE MADE OR ALLO- CATED TO THE ROOSEVELT ISLAND OPERATING CORPORATION AS SUCH CORPORATION WAS CONSTITUTED IMMEDIATELY PRECEDING THE EFFECTIVE DATE OF THIS ACT WHETHER OBLIGATED OR UNOBLIGATED, ARE HEREBY TRANSFERRED TO AND MADE AVAILABLE TO THE ROOSEVELT ISLAND OPERATING CORPORATION AS CREATED BY THIS ACT. ALL RULES, REGULATIONS, ORDERS, DETERMINATIONS, AND DECISIONS OF THE ROOSEVELT ISLAND OPERATING CORPORATION, AS IT WAS CONSTITUTED IMMEDIATELY PRECEDING THE EFFECTIVE DATE OF THIS ACT, SHALL CONTINUE IN FULL FORCE AND EFFECT AS RULES, REGULATIONS, ORDERS, DETERMINATIONS AND DECISIONS OF THE ROOSEVELT ISLAND OPERATING CORPORATION CREATED BY THIS ACT. § 4. This act shall take effect immediately. § 2. This act shall take effect immediately and shall be deemed to have been in full force and effect on the same date and in the same manner as chapter 383 of the laws of 2019 took effect.
