TITLE OF BILL:

An act to amend the education law, in relation to directing the board of
trustees of the state university of New York and the board of trustees
of the city university of New York to freeze tuition at the rate of such
tuition for the two thousand nineteen--two thousand twenty academic year

 
PURPOSE:

To provide tuition relief to students at SUNY and CUNY

 
SUMMARY OF PROVISIONS:

Section one of the bill adds subparagraph (vii) to subparagraph 4 of
paragraph h of subdivision 2 of § 355 of the education law to require
that beginning with the 2020-2021 academic year and thereafter, the
amount of tuition per credit hour at State University of New York be
frozen at the rate of tuition and fees for the 2019-2020 academic year.

Additionally, this section states that the freeze shall apply to full-
time and part-time students and to tuition for New York residents, out-
of-state residents, and on-line students.

Section two of the bill amends subparagraph 4 of paragraph h of subdivi-
sion 2 of § 355 of the education law to make conforming changes from
section one.

Section three of the bill adds subparagraph (vi) to paragraph a of
subdivision 7 of § 6206 of the education law to require that beginning
with the 2020-2021 academic year and thereafter, the amount of tuition
per credit hour at City University of New York be frozen at the rate of
tuition and fees for the 2019-2020 academic year.Additionally, this
section states that the freeze shall apply to full-time and part-time
students and to tuition for New York residents, out-of-state residents,
and on-line students.

Section four of the bill adds subparagraph (iv) to paragraph a of subdi-
vision 7 of § 6206 of the education law to make conforming changes from
section three.

Section five of the bill provides the effective date.

 
JUSTIFICATION:

The cost of a higher education has increased dramatically, and continues
to price out many low- and moderate-income New York student. As we know,
higher education is one of the most transformative ways to help people
achieve the American dream. Students who complete a four-year degree
have a much greater chance of realizing upward economic mobility. For
many students, affordability is a primary factor in choosing to attend a
public college or university. Many students in New York State rely on
financial aid to help fund their higher education costs, and up until
2011, low-income SUNY and CUNY students had their tuition costs covered
in full by the Tuition Assistance Program (TAP).However, over the past
nine years, tuition across CUNY and SUNY campuses has increased almost
42% and in that time period, TAP has failed to cover the entire tuition
cost. New York State law requires that SUNY and CUNY four-year campuses
fund the difference between TAP awards and the full tuition rates at
SUNY and CUNY out of their own operating revenue. This difference is
known as the TAP Gap and cost $139 million in the 2018-18 academic year
and $700 million since 2012.This has led to a loss in the funding of
classrooms, resulting in increased class sizes and requiring SUNY and
CUNY campuses to make other cuts which has led to an erosion of
services.

Higher education is the main vehicle many people use to improve their
economic situation and that of their family. The continuing increase in
tuition has a detrimental impact on those seeking that improvement.
Whereas the enactment of this legislation is estimated to cost approxi-
mately $61 million annually, by freezing tuition rates, New York State
will prioritize students by ensuring they have the proper tools and
services necessary to complete their education.

 AN ACT to amend the education law, in relation to directing the board of
   trustees of the state university of New York and the board of trustees
   of the city university of New York to freeze tuition at  the  rate  of
   such  tuition  for  the  two  thousand  nineteen--two  thousand twenty
   academic year
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subparagraph 4 of paragraph h of subdivision 2 of section
 355 of the education law, as amended by section 1 of part JJJ of chapter
 59 of the laws of 2017, is amended by adding a new subparagraph (vii) to
 read as follows:
   (VII) COMMENCING WITH THE TWO THOUSAND TWENTY--TWO THOUSAND TWENTY-ONE
 ACADEMIC YEAR AND THEREAFTER, THE BOARD OF  TRUSTEES  SHALL  FREEZE  THE
 AMOUNT  OF TUITION PER CREDIT HOUR PER ACADEMIC YEAR AT THE RATE OF SUCH
 TUITION FOR THE TWO  THOUSAND  NINETEEN--TWO  THOUSAND  TWENTY  ACADEMIC
 YEAR.  THIS  FREEZE  SHALL  APPLY TO TUITION FOR FULL-TIME AND PART-TIME
 STUDENTS AND TO TUITION FOR NEW YORK RESIDENTS,  OUT-OF-STATE  RESIDENTS
 AND ON-LINE STUDENTS.
   §  2. Subparagraph 4 of paragraph h of subdivision 2 of section 355 of
 the education law, as amended by chapter 437 of the  laws  of  2015,  is
 amended to read as follows:
   (4)  The trustees shall not impose a differential tuition charge based
 upon need or income. All students enrolled in programs leading  to  like
 degrees  at state-operated institutions of the state university shall be
 charged a uniform rate of tuition except for differential tuition  rates
 based  on  state  residency.  Provided,  however,  that the trustees may
 authorize the presidents of the colleges of technology and the  colleges
 of agriculture and technology to set differing rates of tuition for each
 of  the colleges for students enrolled in degree-granting programs lead-
 ing to an associate degree and non-degree granting programs so  long  as
 such  tuition  rate does not exceed the tuition rate charged to students
 who are enrolled in like degree programs or degree-granting  undergradu-

 ate  programs  leading to a baccalaureate degree at other state-operated
 institutions of the state university of New York.   Notwithstanding  any
 other  provision  of  this  subparagraph, the trustees may authorize the
 setting  of  a  separate category of tuition rate, that shall be greater
 than the tuition rate for resident students and less  than  the  tuition
 rate  for  non-resident students, only for students enrolled in distance
 learning courses who are not residents of the state. [The trustees shall
 not adopt changes affecting tuition charges prior to  the  enactment  of
 the  annual  budget.] COMMENCING WITH THE TWO THOUSAND TWENTY--TWO THOU-
 SAND TWENTY-ONE ACADEMIC YEAR AND  THEREAFTER,  THE  BOARD  OF  TRUSTEES
 SHALL  FREEZE THE AMOUNT OF TUITION PER CREDIT HOUR PER ACADEMIC YEAR AT
 THE RATE OF SUCH TUITION FOR THE  TWO  THOUSAND  NINETEEN--TWO  THOUSAND
 TWENTY  ACADEMIC  YEAR. THIS FREEZE SHALL APPLY TO TUITION FOR FULL-TIME
 AND PART-TIME STUDENTS AND TO TUITION FOR NEW  YORK  RESIDENTS,  OUT-OF-
 STATE RESIDENTS AND ON-LINE STUDENTS.
   §  3.  Paragraph  a  of subdivision 7 of section 6206 of the education
 law, as amended by section 2 of part JJJ of chapter 59 of  the  laws  of
 2017, is amended by adding a new subparagraph (vi) to read as follows:
   (VI)  COMMENCING WITH THE TWO THOUSAND TWENTY--TWO THOUSAND TWENTY-ONE
 ACADEMIC YEAR AND THEREAFTER, THE BOARD OF  TRUSTEES  SHALL  FREEZE  THE
 AMOUNT  OF TUITION PER CREDIT HOUR PER ACADEMIC YEAR AT THE RATE OF SUCH
 TUITION FOR THE TWO  THOUSAND  NINETEEN--TWO  THOUSAND  TWENTY  ACADEMIC
 YEAR.  THIS  FREEZE  SHALL  APPLY TO TUITION FOR FULL-TIME AND PART-TIME
 STUDENTS AND TO TUITION FOR NEW YORK RESIDENTS,  OUT-OF-STATE  RESIDENTS
 AND ON-LINE STUDENTS.
   §  4.  Paragraph  a  of subdivision 7 of section 6206 of the education
 law, as amended by chapter 327 of the laws of 2002,  the  opening  para-
 graph  as  amended  by  chapter  437  of the laws of 2015, is amended by
 adding a new subparagraph (iv) to read as follows:
   (IV) COMMENCING WITH THE TWO THOUSAND TWENTY--TWO THOUSAND  TWENTY-ONE
 ACADEMIC  YEAR  AND  THEREAFTER,  THE BOARD OF TRUSTEES SHALL FREEZE THE
 AMOUNT OF TUITION PER CREDIT HOUR PER ACADEMIC YEAR AT THE RATE OF  SUCH
 TUITION  FOR  THE  TWO  THOUSAND  NINETEEN--TWO THOUSAND TWENTY ACADEMIC
 YEAR. THIS FREEZE SHALL APPLY TO TUITION  FOR  FULL-TIME  AND  PART-TIME
 STUDENTS  AND  TO TUITION FOR NEW YORK RESIDENTS, OUT-OF-STATE RESIDENTS
 AND ON-LINE STUDENTS.
   § 5. This act shall take effect immediately and shall apply to academ-
 ic years commencing on and after July 1, 2020; provided, however, that:
   a. the amendments to subparagraph 4 of paragraph h of subdivision 2 of
 section 355 of the education law made by section one of this  act  shall
 be subject to the expiration and reversion of such paragraph pursuant to
 section  16  of  chapter  260 of the laws of 2011, as amended, when upon
 such date the provisions of section two of this act shall  take  effect;
 and
   b.  the  amendments to paragraph a of subdivision 7 of section 6206 of
 the education law made by section three of this act shall be subject  to
 the expiration and reversion of such paragraph pursuant to section 16 of
 chapter  260  of  the  laws of 2011, as amended, when upon such date the
 provisions of section four of this act shall take effect.
