BILL NUMBER: S7696 SPONSOR: CARLUCCI TITLE OF BILL: An act to amend the social services law, in relation to prohibiting prior authorization for medically necessary and warranted ultrasounds PURPOSE OR GENERAL IDEA OF THE BILL: To prohibit managed care providers from requiring prior authorization for any ultrasound that a physician deems to be medically necessary and warranted SUMMARY OF SPECIFIC PROVISIONS: Section one of the bill amends the social services law by adding a new subdivision 26-c prohibiting managed care providers from requiring prior authorization for any ultrasound, which, in a physician's reasonable professional judgment, are medically necessary and warranted.

CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the social services law, in relation to prohibiting prior authorization for medically necessary and warranted ultrasounds THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 364-j of the social services law is amended by adding a new subdivision 26-c to read as follows: 26-C. MANAGED CARE PROVIDERS SHALL NOT REQUIRE PRIOR AUTHORIZATION FOR ANY ULTRASOUND, WHICH, IN A PHYSICIAN'S REASONABLE PROFESSIONAL JUDG- MENT, ARE MEDICALLY NECESSARY AND WARRANTED. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15214-02-0
