BILL NUMBER: S8146 SPONSOR: FUNKE TITLE OF BILL: An act to amend the criminal procedure law, in relation to granting peace officer status to officers and members of the security force of Rochester General Hospital PURPOSE OR GENERAL IDEA OF BILL: To grant security officers at Rochester General Hospital with peace officer powers subject to certain conditions SUMMARY OF PROVISIONS: Section 1: Amends Section 2.10 of the Criminal Procedure Law by adding a new subdivision 86, which will confer peace officer status on the members of Rochester General Hospital's security force. The bill provides that the peace officer powers would only apply on the grounds owned, controlled, or administered by the Rochester General Hospital,

FUNKE -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to granting peace officer status to officers and members of the security force of Rochester General Hospital THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 86 to read as follows: 86. OFFICERS AND MEMBERS OF THE SECURITY FORCE EMPLOYED BY THE ROCHES- TER GENERAL HOSPITAL. OFFICERS EMPLOYED BY THE ROCHESTER GENERAL HOSPI- TAL SHALL HAVE THE POWERS OF PEACE OFFICERS WITHIN THE GEOGRAPHIC AREA OCCUPIED BY THE ROCHESTER GENERAL HOSPITAL, INCLUDING THE GROUNDS AND PREMISES OWNED, CONTROLLED, OR ADMINISTERED BY THE ROCHESTER GENERAL HOSPITAL, AND ANY PUBLIC STREET AND SIDEWALK THAT ABUTS THE GROUNDS, BUILDINGS OR PROPERTY OF SUCH GROUNDS AND PREMISES. THESE OFFICERS SHALL ONLY HAVE THE POWERS LISTED IN PARAGRAPHS (A), (B), (C), (D), (E), (H), AND (I) OF SUBDIVISION ONE OF SECTION 2.20 OF THIS ARTICLE, AS WELL AS THE POWER TO DETAIN AN INDIVIDUAL FOR A REASONABLE PERIOD OF TIME WHILE AWAITING THE ARRIVAL OF LAW ENFORCEMENT, PROVIDED THAT THE OFFICER HAS ACTUAL KNOWLEDGE, OR PROBABLE CAUSE TO BELIEVE, THAT SUCH INDIVIDUAL HAS COMMITTED AN OFFENSE; PROVIDED HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW. § 2.
