BILL NUMBER: S8278 SPONSOR: KENNEDY TITLE OF BILL: An act to amend the education law, in relation to establishing a program to incentivize unemployed individuals to enter jobs in healthcare PURPOSE: This legislation amends the education law to require the New York State Departments of Health, Labor, and Education to establish a program that incentivizes unemployed individuals to enter jobs in healthcare. SUMMARY OF SPECIFIC PROVISIONS: The legislation would add subdivision 59 to the education law. Section one requires the Commissioners of Health, Labor, and Education to establish a program that incentivizes unemployed individuals to enter jobs in healthcare, including but not limited to certified nurse aides.

KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to establishing a program to incentivize unemployed individuals to enter jobs in healthcare THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 305 of the education law is amended by adding a new subdivision 59 to read as follows: 59. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, THE COMMIS- SIONER, IN CONJUNCTION WITH THE COMMISSIONER OF HEALTH AND THE COMMIS- SIONER OF LABOR SHALL ESTABLISH A PROGRAM WHICH INCENTIVIZES UNEMPLOYED INDIVIDUALS TO ENTER JOBS IN HEALTHCARE, INCLUDING BUT NOT LIMITED TO, CERTIFIED NURSE AIDES. SUCH INCENTIVES SHALL INCLUDE, BUT NOT BE LIMITED TO, EXPEDITED TRAINING AND CERTIFICATION PROCESSES FOR SUCH HEALTHCARE POSITIONS AS DETERMINED BY THE COMMISSIONER. § 2. Section 599 of the labor law is amended by adding a new subdivision 4 to read as follows: 4. ESTABLISHING ELIGIBLE TRAINING PROGRAMS AND RECRUITMENT IN THE HEALTHCARE FIELD. (A) THE COMMISSIONER, IN CONSULTATION WITH THE COMMIS- SIONER OF HEALTH, SHALL MAINTAIN A LIST OF POSITIONS IN THE HEALTHCARE FIELD IN WHICH THERE ARE SUBSTANTIAL STAFF SHORTAGES STATEWIDE AND PER REGION OF THE STATE, THAT IS UPDATED AT LEAST ONCE EVERY CALENDAR YEAR. SUCH LIST SHALL BE ESTABLISHED WITHIN SIXTY DAYS OF THE EFFECTIVE DATE OF THIS SUBDIVISION AND SHALL BE PUBLISHED ON THE DEPARTMENT'S WEBSITE. (B) THE COMMISSIONER, IN CONSULTATION WITH THE COMMISSIONER OF HEALTH, SHALL ESTABLISH A PROGRAM ELIGIBLE UNDER THIS SECTION THAT PROVIDES EXPEDITED TRAINING AND CERTIFICATION PROCESSES FOR THE HEALTHCARE POSI- TIONS ON THE LIST ESTABLISHED PURSUANT TO PARAGRAPH (A) OF THIS SUBDIVI- SION THAT WOULD BE AVAILABLE TO CLAIMANTS ELIGIBLE UNDER THIS SECTION. THE DEPARTMENT SHALL MAKE INFORMATION ABOUT SUCH PROGRAM AVAILABLE ON ITS WEBSITE. SUCH PROGRAM SHALL BE ESTABLISHED WITHIN ONE HUNDRED EIGHTY DAYS OF THE EFFECTIVE DATE OF THIS SUBDIVISION. § 2.
