BILL NUMBER: S831 SPONSOR: GALLIVAN TITLE OF BILL: An act to amend the environmental conservation law, in relation to providing a fishing license exemption for disabled persons that do not live in a group home PURPOSE OR GENERAL IDEA OF BILL: To allow people with disabilities the ability to more easily enjoy the therapeutic value of fishing and the outdoors. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Amends the Environmental Conservation Law to allow any person who is sixteen years or older to take fish frogs as if they held a fish- ing license. Section 2. Establishes the effective date.

GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to providing a fishing license exemption for disabled persons that do not live in a group home THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 11-0707 of the environmental conservation law is amended by adding a new subdivision 3-a to read as follows: 3-A. ANY PERSON WHO IS SIXTEEN YEARS OF AGE OR OLDER AND IS DISABLED AS DEFINED UNDER SUBDIVISION FIVE OF SECTION TWO HUNDRED EIGHT OF THE SOCIAL SERVICES LAW AND DOES NOT LIVE IN A GROUP HOME AS DEFINED UNDER SUBDIVISION SEVENTEEN OF SECTION THREE HUNDRED SEVENTY-ONE OF THE SOCIAL SERVICES LAW MAY TAKE FISH OR FROGS AS IF THEY HELD A FISHING LICENSE, EXCEPT THAT THEY MAY NOT TAKE BAIT FISH BY NET OR TRAP. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD02886-01-9
