 Introduced  by  Sen.  BAILEY -- read twice and ordered printed, and when
   printed to be committed to the Committee on Investigations and Govern-
   ment Operations
 
 AN ACT to amend the executive law, in relation to prohibiting denial  of
   entry  to  a  public place or denial of service solely on the basis of
   wearing a mask in public during an epidemic or a pandemic

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  1  of  section  296  of the executive law is
 amended by adding a new paragraph (i) to read as follows:
   (I) FOR  ANY  PERSON,  AGENCY,  BUREAU,  CORPORATION  OR  ASSOCIATION,
 INCLUDING  THE  STATE  AND  ANY POLITICAL SUBDIVISION THEREOF, TO DENY A
 PERSON ENTRY TO A PUBLIC PLACE OR DENY A PERSON SERVICE  SOLELY  ON  THE
 BASIS  OF  WEARING  A  MASK  IN  PUBLIC  DURING A STATE EMERGENCY FOR AN
 EPIDEMIC OR A PANDEMIC.
   § 2. This act shall take effect immediately.
