BILL NUMBER: S8484 SPONSOR: METZGER TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises PURPOSE OR GENERAL IDEA OF BILL: This bill would allow Tony & Nick's Italian Kitchen to obtain a full liquor license for the on-premises consumption of alcohol SUMMARY OF PROVISIONS: Section 1 of this bill amends Subdivision 7 of Section 64 of the Alcohol Beverage Control Law, adding a new paragraph (e-10) to allow the issu- ance of a retail license for on-premises consumption of alcohol for a premises within 200 feet of a place of worship, provided that the purpose of such premises is for the sale and consumption of food or beverage, and such premises is within the boundaries of Ulster County as

METZGER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-11) to read as follows: (E-11) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDI- VISION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMPTION FOR A PREMISES WHICH SHALL BE LOCATED WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED EXCLUSIVELY AS A CHURCH, SYNAGOGUE, OR OTHER PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTES A PREMISES FOR THE SALE OF FOOD OR BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE COUNTY OF ULSTER, BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT PIECE OR PARCEL OF LAND, SITUATED IN THE VILLAGE OF ELLEN- VILLE, TOWN OF WAWARSING, COUNTY OF ULSTER AND STATE OF NEW YORK, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT IN THE NORTHEASTERLY LINE OF CANAL ST. AT ITS INTERSECTION WITH THE SOUTHEASTERLY LINE OF HERMANCE ST, SAID POINT ALSO BEING THE MOST WESTERLY CORNER OF LANDS HEREIN DESCRIBED: RUNNING THENCE ALONG THE SOUTHEASTERLY LINE OF HERMANCE STREET, NORTH 44 DEGREES 57 MINUTES 27 SECONDS EAST, A DISTANCE OF 105.52 FEET TO A POINT BEING THE MOST WESTERLY QUARTER OF LANDS NOW OR FORMERLY SEQUI, LIBER 1885 AT PAGE 56, SAID POINT ALSO BEING THE MOST NORTHERLY CORNER OF LANDS HEREIN DESCRIBED; THENCE ALONG THE SOUTHWESTERLY LINE NOW OR FORMERLY SEGUI, AND GENER- ALLY FOLLOWING A WOOD FENCE A PORTION OF THE WAY, SOUTH 44 DEGREES 55 MINUTES 42 SECONDS EAST, A DISTANCE OF 89.54 FEET TO A POINT IN THE NORTHERLY LINE OF LANDS NOW OR FORMERLY HOSANNA ASSEMBLIES OF GOD, INC., SAID POINT ALSO BEING AN EASTERLY CORNER OF LAND HEREIN DESCRIBED; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
