BILL NUMBER: S8585 SPONSOR: MAY TITLE OF BILL: An act in relation to authorizing school districts to use school trans- portation aid to pay for the cost and expenses of transporting and delivering meals, homework materials and any other school materials to students during the COVID-19 pandemic PURPOSE: To qualify meal and homework delivery to students during the COVID-19 pandemic for reimbursement under school transportation aid. SUMMARY OF PROVISIONS: Section 1: authorizes the use of school transportation aid to pay for the cost and expenses of transporting and delivering meals, homework, and other school materials to students during the public health emergen- cy.

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT in relation to authorizing school districts to use school trans- portation aid to pay for the cost and expenses of transporting and delivering meals, homework materials and any other school materials to students during the COVID-19 pandemic THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, if, as a result of the state of emergency declared as a result of the COVID-19 pandemic that was executed in Executive Order No. 202 on March 7, 2020, and for the period beginning March 7, 2020 and ending July 1, 2020, any school district in this state that received school aid for the 2019-2020 school year for transportation expenses pursuant to part 2 of article 73 of title 5 of the education law or any other provision of law, is author- ized to use any portion of such school aid for transportation expenses to pay for the cost and expenses of transporting and delivering meals, homework materials and any other school materials to students during such period of time. § 2. SUMMARY OF PROVISIONS: Section 1: adds a new subdivision 8 to Section 3622-a of the education law, to include the transportation of meals and other materials during the COVID-19 emergency declaration in the computation of aidable trans- portation aid.

NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, THE TRANSPORTATION OF MEALS, EDUCATIONAL MATERIALS, AND ANY OTHER SCHOOL- RELATED MATERIALS FOR THE PERIOD THAT BEGAN WITH THE DECLARATION OF THE STATE OF EMERGENCY DECLARED AS A RESULT OF THE COVID-19 PANDEMIC THAT WAS EXECUTED IN EXECUTIVE ORDER TWO HUNDRED TWO THAT BEGAN ON MARCH SEVENTH, TWO THOUSAND TWENTY. § 2. Paragraph e of subdivision 1 of section 3623-a of the education law is amended by adding a new subparagraph 12 to read as follows: (12) NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, THE TRANSPORTATION OF MEALS, EDUCATIONAL MATERIALS, AND ANY OTHER SCHOOL- RELATED MATERIALS FOR THE PERIOD THAT BEGAN WITH THE DECLARATION OF THE STATE OF EMERGENCY DECLARED AS A RESULT OF THE COVID-19 PANDEMIC THAT WAS EXECUTED IN EXECUTIVE ORDER TWO HUNDRED TWO THAT BEGAN ON MARCH SEVENTH, TWO THOUSAND TWENTY. § 3.
