TITLE OF BILL:

An act to amend the social services law, in relation to requiring the
commissioner to prepare a report of the sheltered and unsheltered home-
less population during a state disaster emergency

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill would require the Commissioner of the Department of Health,
the Commissioners of the Department of Homeless Services, and the
Commissioner of the New York City Department of Health and Mental
Hygiene, in consultation with the local Departments of Health, to report
on the number of sheltered and unsheltered homeless individuals and
families during a state disaster emergency.

 
SUMMARY OF PROVISIONS:

Section one of the bill amends section 17 of the Social Services Law by

adding a new subdivision (d-1) that creates reporting requirements for
the local Departments of Health on homeless individuals during a state
disaster emergency. This bill would require the reporting of the number
of infected individuals, number of hospitalizations, number of deaths,
information regarding the individual including; age, race, family compo-
sition and shelter status including the type of shelter utilized by the
individual, if there are any known risk factors, and any other informa-
tion the commissioners deem necessary.  The Commissioners will aggregate
data by county and post the reports to each respective agency's website.

Section two of the bill establishes the effective date.

 
JUSTIFICATION:

The impact of the COVID-19 virus on the homeless population in New York
is still relatively unclear. We do know the virus will disproportionate-
ly impacted by this vulnerable population due to a lack of safe, private
and clean-living spaces. Since the spread of the virus in New York, this
group finds themselves at a particularly high risk of transmission,
hospitalization, and death. In order to better protect the homeless in
our state we must have as much information as possible. This legislation
aims to provide relevant information on the effects of the pandemic on
the homeless in New York with the hope of using this information to
provide adequate care and protections going forward.

 AN ACT to amend the social services law, in relation  to  requiring  the

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Section 17 of the social services law is amended by adding
 a new subdivision (d-1) to read as follows:
   (D-1)(1) IN CONSULTATION WITH EACH  LOCAL  HEALTH  DEPARTMENT  IN  THE
 COUNTY IN WHICH THE HOMELESS SHELTER IS LOCATED, THE COMMISSIONER OF THE
 DEPARTMENT  OF  HEALTH,  THE COMMISSIONERS OF THE DEPARTMENT OF HOMELESS
 SERVICES, AND THE COMMISSIONER OF THE NEW YORK CITY DEPARTMENT OF HEALTH
 AND MENTAL HYGIENE, SHALL COLLECT INFORMATION  REGARDING  THE  SHELTERED
 AND  UNSHELTERED HOMELESS POPULATION, DURING A STATE DISASTER EMERGENCY,
 AS DEFINED IN SECTION TWENTY OF THE EXECUTIVE  LAW,  INCLUDING  BUT  NOT
 LIMITED TO:
   (I) THE NUMBER OF CONFIRMED INFECTED INDIVIDUALS;
   (II) THE NUMBER OF HOSPITALIZATIONS;
   (III) THE NUMBER OF DEATHS;
   (IV)  INFORMATION  REGARDING  THE  INDIVIDUAL,  IF KNOWN; (A) AGE; (B)
 RACE; (C) FAMILY COMPOSITION; (D) SHELTER STATUS; (E)  TYPE  OF  SHELTER
 INCLUDING:  FAMILY  SHELTER, A SHELTER FOR ADULTS, A HOTEL, AN EMERGENCY
 APARTMENT, A DOMESTIC VIOLENCE SHELTER, A  RUNAWAY  AND  HOMELESS  YOUTH
 SHELTER,  OR  AS  A SAFE HOUSE FOR REFUGEES; (F) ANY KNOWN RISK FACTORS;
 AND (G) ANY OTHER INFORMATION THE OFFICE DEEMS APPROPRIATE.
   (2) UTILIZING THE INFORMATION COLLECTED PURSUANT TO PARAGRAPH  (1)  OF
 THIS  SUBDIVISION,  THE  COMMISSIONERS SHALL PUBLISH A REPORT CONTAINING
 SUCH INFORMATION AGGREGATED BY COUNTY AND POST IT ON THE WEBSITE OF EACH
 RESPECTIVE AGENCY.
   § 2. This act shall take effect immediately.

DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE):

Clarifies that state disaster emergency shall only refer to the state
disaster emergency, declared pursuant to executive order 202 of 2020 in
response to the novel coronavirus (COVID-19) pandemic. Also, amends the
effective date to reflect this change.

 
JUSTIFICATION:

The impact of the COVID-19 virus on the homeless population in New York

   (III) THE NUMBER OF DEATHS;
   (IV) INFORMATION REGARDING THE INDIVIDUAL,  IF  KNOWN;  (A)  AGE;  (B)
 RACE;  (C)  FAMILY  COMPOSITION; (D) SHELTER STATUS; (E) TYPE OF SHELTER
 INCLUDING: FAMILY SHELTER, A SHELTER FOR ADULTS, A HOTEL,  AN  EMERGENCY
 APARTMENT,  A  DOMESTIC  VIOLENCE  SHELTER, A RUNAWAY AND HOMELESS YOUTH
