TITLE OF BILL:

An act to amend the public service law, in relation to requiring elec-
tric corporations to prioritize restoring services to police depart-
ments, fire departments, and ambulance services, when electric services
are interrupted

 
PURPOSE:

This legislation seeks to ensure that our police, fire, and ambulance
services are provided with alternate power sources by electric companies
if their power is not able to be restored within 24 hours.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 adds a new section 73 to the public service law to o ensure
that our police, fire, and ambulance services are provided with alter-
nate power sources by electric companies if their power is not able to

be restored within 24 hours.  This section also states that an electric
corporation shall not increase charges to any rate payer to cover any
extra cost. This section also defines alternate generated power.

Section 2 is the effective date.

 
JUSTIFICATION:

Our life saving services such as police, fire, and ambulance services
play a critical role in saving citizens lives.  Their ability to operate
at full capacity comes into question when they do not have power. While
some of police, fire, and ambulance services have some redundancy not
all do. This legislation would help ensure that all police, fire, and
ambulance have the ability to maintain adequate electricity to operate
all life safety systems, as well as their basic operations. If we are
able to take care of our first responders in these trying situations,
they will be better positioned to assist the citizens they are serving.

 AN ACT to amend the public service law, in relation to  requiring  elec-
   tric  corporations  to prioritize restoring services to police depart-
   ments,  fire  departments,  and  ambulance  services,  when   electric
   services are interrupted

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public service law is amended by adding a  new  section
 73 to read as follows:
   §  73. PRIORITIZATION OF EMERGENCY SERVICES. 1.  IF AN ELECTRIC CORPO-
 RATION IS NOT ABLE TO RESTORE ELECTRIC  POWER  SERVICES  TO  ANY  POLICE
 DEPARTMENT,  FIRE  DEPARTMENT,  OR  AMBULANCE SERVICE WITHIN TWENTY-FOUR
 HOURS OF THE LOSS OR INTERRUPTION OF SUCH ELECTRIC POWER SERVICES,  SUCH
 ELECTRIC  CORPORATION SHALL PROVIDE SUCH POLICE DEPARTMENT, FIRE DEPART-
 MENT, AND/OR AMBULANCE SERVICE WITH AN ALTERNATE GENERATED POWER SOURCE.
   2. AN ELECTRIC CORPORATION SHALL NOT  INCREASE  CHARGES  TO  ANY  RATE
 PAYERS TO COVER ANY EXTRA COSTS INCURRED BY SUCH ELECTRIC CORPORATION AS
 A RESULT OF COMPLIANCE WITH SUBDIVISION ONE OF THIS SECTION.
   3.  FOR  THE  PURPOSES  OF  THIS  SECTION,  "ALTERNATE GENERATED POWER
 SOURCE" SHALL MEAN ELECTRIC GENERATING EQUIPMENT THAT IS OF THE CAPACITY
 THAT IS CAPABLE OF PROVIDING ADEQUATE ELECTRICITY TO  OPERATE  ALL  LIFE
 SAFETY  SYSTEMS  AND  THE  BASIC OPERATIONS OF A POLICE DEPARTMENT, FIRE
 DEPARTMENT, OR AMBULANCE SERVICE.
   § 2. This act shall take effect immediately.
