 Introduced  by  Sen. SANDERS -- read twice and ordered printed, and when
   printed to be committed to the Committee on Rules
 
 AN ACT to amend the general municipal  law,  in  relation  to  requiring
   individuals  or  corporations  to obtain a sound permit from a munici-
   pality in certain situations
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  general  municipal  law  is  amended by adding a new
 section 99-x to read as follows:
   § 99-X. SOUND PERMIT REQUIREMENT.  1.  AN  INDIVIDUAL  OR  CORPORATION
 SHALL  BE REQUIRED TO APPLY FOR AND OBTAIN A SOUND PERMIT FROM A MUNICI-
 PALITY IF:
   (A) A SOUND SOURCE IS PLANNED, INSTALLED OR INTENDED TO BE  INSTALLED,
 OR  MODIFIED  BY  ANY  INDIVIDUAL  OR  CORPORATION IN A MANNER THAT SUCH
 SOURCE WILL CREATE OR IS LIKELY TO CREATE UNREASONABLE NOISE;
   (B) ANY INDIVIDUAL OR CORPORATION USES OR PLANS TO USE  ANY  SOUND-AM-
 PLIFYING  EQUIPMENT  IN A MANNER THAT SUCH EQUIPMENT IS OR WILL BE HEARD
 OUTSIDE OF ANY BUILDING OR VEHICLE DURING NIGHTTIME HOURS; OR
   (C) ANY INDIVIDUAL OR CORPORATION USES OR PLANS TO  USE  A  PUBLIC-AD-
 DRESS SYSTEM THAT WILL PRODUCE UNREASONABLE NOISE OUTSIDE OF A BUILDING.
   2.  APPLICATIONS  FOR  A  SOUND  PERMIT SHALL BE SUBMITTED SEVENTY-TWO
 HOURS IN ADVANCE OF AN EVENT IN A MANNER  AND  FORM  PRESCRIBED  BY  THE
 MUNICIPALITY.
   3.  THE  FAILURE  OF ANY INDIVIDUAL OR CORPORATION TO COMPLY WITH THIS
 SECTION SHALL RESULT IN THE ISSUANCE OF A WRITTEN WARNING BY THE MUNICI-
 PALITY. ANY INDIVIDUAL OR CORPORATION WHO VIOLATES THIS SECTION:
   (A) FOR A SECOND TIME SHALL BE SUBJECT TO  A  CIVIL  PENALTY  OF  FIVE
 HUNDRED DOLLARS;
   (B)  FOR A THIRD TIME SHALL BE SUBJECT TO A CIVIL PENALTY OF ONE THOU-
 SAND DOLLARS; AND
   (C) FOR EACH ADDITIONAL VIOLATION AFTER THAT, SHALL BE  SUBJECT  TO  A
 CIVIL  PENALTY OF AN ADDITIONAL ONE THOUSAND DOLLARS ADDED TO THE PREVI-
 OUS VIOLATION AMOUNT CHARGED.
   § 2. This act shall take effect immediately.
