S T A T E O F N E W Y O R K ________________________________________________________________________ 10492 I N A S S E M B L Y May 28, 2022 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Reyes) -- read once and referred to the Committee on Ways and Means AN ACT to amend the labor law, in relation to employer violations of certain provisions allowing for workplace safety committees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 27-d of the labor law is amended by adding a new subdivision 9 to read as follows: 9. (A) AN EMPLOYER MUST RECOGNIZE WITHIN FIVE BUSINESS DAYS THE ESTAB- LISHMENT OF A WORKPLACE SAFETY COMMITTEE CREATED PURSUANT TO THIS SECTION. VIOLATIONS OF THIS SUBDIVISION SHALL RESULT IN A CIVIL PENALTY OF NOT LESS THAN FIFTY DOLLARS PER DAY UNTIL THE VIOLATION IS REMEDIED. (B) THE COMMISSIONER MAY ALSO ORDER OTHER APPROPRIATE RELIEF INCLUDING ENJOINING THE CONDUCT OF ANY PERSON OR EMPLOYER IN ADDITION TO ANY OTHER REMEDIES PERMITTED BY THIS SECTION. § 2.
