AN ACT to amend the election law, in relation to requiring the board of
elections to provide the public with free and timely access to updated
unofficial election results
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Paragraph (b) of subdivision 2 of section 9-126 of the
election law, as amended by chapter 334 of the laws of 2013, is amended
to read as follows:
(b) The board of elections shall remain open after the close of the
polls and shall receive and tabulate the voting results as they are
received. The board of elections shall make such unofficial results
available to the media and the state board of elections, and shall post
running totals FOR EACH ELECTION DISTRICT in a public place and on the
internet as the results become known to it.
§ 2. Paragraph (e) of subdivision 2 of section 9-209 of the election
law, as amended by chapter 104 of the laws of 2010, is amended to read
as follows:
(e) Upon completing the casting and canvassing of ballots as hereina-
bove provided for [any] EACH election district, the central board of
inspectors shall thereupon[, as nearly as practicable in the manner
provided in this chapter for absentee ballots,] verify the number of
ballots so cast, tally the votes so cast, add such tally to the previous
tally of all votes cast in such election district, and announce the
result.
§ 3. Subdivision 2 of section 9-209 of the election law is amended by
adding a new paragraph (f) to read as follows:
(F) UPON COMPLETING THE CASTING AND CANVASSING OF ABSENTEE, MILITARY,
AND SPECIAL BALLOTS FOR EACH ELECTION DISTRICT, THE BOARD OF ELECTIONS
SHALL MAKE ABSENTEE RESULTS AVAILABLE TO THE MEDIA AND THE STATE BOARD
OF ELECTIONS, AND SHALL POST RUNNING TOTALS FOR EACH ELECTION DISTRICT
IN A PUBLIC PLACE AND ON THE INTERNET.
§ 4. This act shall take effect immediately.
