 AN ACT to amend the general business law, in relation to prohibiting the
   sale of certain balloons
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The general business law is amended by adding a new section
 399-k to read as follows:
   §  399-K. PROHIBIT THE SALE OF CERTAIN BALLOONS. 1. IT SHALL BE UNLAW-
 FUL FOR ANY PERSON, FIRM,    PARTNERSHIP  OR  CORPORATION  TO  KNOWINGLY
 IMPORT,  SELL,  OFFER  FOR  SALE,  MANUFACTURE, DISTRIBUTE, TRANSPORT OR
 OTHERWISE MARKET ANY BALLOON  OR  OTHER  INFLATABLE  OBJECT  MADE  OF  A
 CONDUCTIVE  MATERIAL,  INCLUDING BUT NOT LIMITED TO MYLAR, FILLED WITH A
 GAS WHICH IS LIGHTER THAN AIR WITHOUT:
   (A) A WEIGHT AFFIXED TO SUCH OBJECT WHICH  PREVENTS  THE  OBJECT  FROM
 BEING LIGHTER THAN AIR;
   (B) A WARNING STATEMENT ATTACHED TO SUCH OBJECT; OR
   (C)  IDENTIFICATION  INFORMATION  OF  THE  MANUFACTURER PRINTED ON THE
 OBJECT.
   2. IT SHALL BE UNLAWFUL FOR ANY PERSON, FIRM,  PARTNERSHIP  OR  CORPO-
 RATION  TO KNOWINGLY IMPORT, SELL, OFFER FOR SALE, MANUFACTURE, DISTRIB-
 UTE, TRANSPORT OR OTHERWISE  MARKET  ANY  BALLOON  OR  OTHER  INFLATABLE
 OBJECT  WHICH  HAS  ATTACHED  AN ELECTRICALLY CONDUCTIVE STRING, TETHER,
 STREAMER, OR OTHER ELECTRICALLY CONDUCTIVE APPURTENANCE.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law.
