2021-A2018 (ACTIVE) - Summary

Prohibits a school district in a city having a population of one million or more inhabitants from changing the transportation accommodation of an older sibling who lives with and goes to either the same school as or a school located at the same place as a younger sibling who shares the same transportation accommodation.

 AN  ACT to amend the education law, in relation to transportation accom-
   modations for siblings

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  3635 of the education law is amended by adding a
 new subdivision 9 to read as follows:
   9. NOTWITHSTANDING ANY PROVISION OF LAW TO  THE  CONTRARY,  NO  SCHOOL
 DISTRICT  IN  A CITY HAVING A POPULATION OF ONE MILLION OR MORE INHABIT-
 ANTS SHALL CHANGE A TRANSPORTATION ACCOMMODATION FOR A CHILD WHO:
   A. ATTENDS GRADE KINDERGARTEN THROUGH EIGHT;
   B. HAS A YOUNGER SIBLING WHO:
   (I) ATTENDS GRADE KINDERGARTEN THROUGH EIGHT;
   (II) HAS A TRANSPORTATION ACCOMMODATION EITHER TO THE SAME SCHOOL OR A
 SCHOOL AT THE SAME PHYSICAL LOCATION; AND
   (III) LIVES AT THE SAME ADDRESS; AND
   C. EITHER CURRENTLY OR AT ANY POINT PREVIOUSLY HAD THE SAME  TRANSPOR-
 TATION ACCOMMODATION AS SUCH YOUNGER SIBLING.
   §  2.  This act shall take effect on the first of July next succeeding
 the date on which it shall have become a law.
