 AN ACT to amend the education law, in relation  to  world  trade  center
   memorial  scholarships and memorial scholarships for children, spouses
   and financial dependents of  deceased  firefighters,  volunteer  fire-
   fighters,  police  officers,  peace  officers,  and  emergency medical
   service workers
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  2  of section 668-b of the education law, as
 amended by chapter 176 of the laws  of  2002,  is  amended  to  read  as
 follows:
   2.  NOTWITHSTANDING  THE PROVISIONS OF SUBDIVISION FOUR OF SECTION SIX
 HUNDRED SIXTY-ONE OF THIS PART, STUDENTS OTHERWISE ELIGIBLE MAY  RECEIVE
 AN  AWARD  UNDER THIS SECTION FOR PART-TIME ATTENDANCE AS DEFINED BY THE
 COMMISSIONER.
   3. Awards under this section shall be payable for  each  of  not  more
 than  four  academic years of undergraduate study or five academic years
 if a program normally requires five years, as defined by the commission-
 er pursuant to article thirteen of this title;  PROVIDED,  HOWEVER  THAT
 SUCH  PERIOD  SHALL  BE  EXTENDED FOR RECIPIENTS WHO ATTEND PART-TIME AS
 DEFINED BY THE COMMISSIONER.
   § 2. Subdivision 3 of section 668-d of the education law, as added  by
 chapter 176 of the laws of 2002, is amended to read as follows:
   3.  PART-TIME ATTENDANCE.   NOTWITHSTANDING THE PROVISIONS OF SUBDIVI-
 SION FOUR OF SECTION SIX HUNDRED SIXTY-ONE OF THIS PART, STUDENTS OTHER-
 WISE ELIGIBLE MAY RECEIVE AN AWARD  UNDER  THIS  SECTION  FOR  PART-TIME
 ATTENDANCE AS DEFINED BY THE COMMISSIONER.
   4.  Duration.  Awards  under this section shall be payable for each of
 not more than four academic years of undergraduate study or five academ-
 ic years if a program normally requires five years, as  defined  by  the

   § 3. This act shall take effect immediately.
