 AN ACT to amend the education law, in relation to prohibiting the use of
   the  onset  of menarche to determine a student's physical maturity for
   the purpose of permitting such  student  to  participate  in  athletic
   activities

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The education law is amended by adding a new section  904-a
 to read as follows:
   §  904-A.  PHYSICAL  EVALUATIONS  REQUIRED  PRIOR  TO PARTICIPATION IN
 CERTAIN ATHLETIC ACTIVITIES. THE COMMISSIONER SHALL PROMULGATE RULES AND
 REGULATIONS PROHIBITING THE USE OF THE ONSET OF MENARCHE AS A MEASURE OF
 A STUDENT'S LEVEL OF PHYSICAL DEVELOPMENT AND MATURITY WHEN  DETERMINING
 THAT  THE STUDENT'S PARTICIPATION IN AN ATHLETIC ACTIVITY WILL NOT PRES-
 ENT A SAFETY OR HEALTH CONCERN FOR SUCH STUDENT.
   § 2. This act shall take effect on the first of July  next  succeeding
 the date on which it shall have become a law. Effective immediately, the
 addition,  amendment  and/or  repeal of any rule or regulation necessary
 for the implementation of this act on its effective date are  authorized
 to be made and completed on or before such effective date.
