 AN  ACT  to  amend the executive law, in relation to minority and women-
   owned business enterprises in state contracts
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 313 of the executive law is amended by adding a new
 subdivision 6-a to read as follows:
   6-A.  NOTWITHSTANDING  THE  PROVISIONS  OF  SUBDIVISION  SIX  OF  THIS
 SECTION, CONTRACTING AGENCIES SHALL ONLY REQUIRE A CONTRACTOR TO  COMPLY
 WITH  THE  PROVISIONS OF THIS SECTION AT A RATE THAT CORRELATES WITH THE
 PERCENTAGE OF CERTIFIED MINORITY AND WOMEN-OWNED BUSINESS ENTERPRISES IN
 THAT INDUSTRY IN THE ECONOMIC DEVELOPMENT REGION WHERE THE  CONTRACT  IS
 TO  BE  PERFORMED. SUCH PERCENTAGE OF CERTIFIED MINORITY AND WOMEN-OWNED
 BUSINESS ENTERPRISES IN EACH REGION, AS SUCH PERCENTAGE APPLIES  TO  THE
 INDUSTRIES  SET  FORTH  IN  SUBDIVISION  ONE  OF  THIS SECTION, SHALL BE
 PUBLISHED ON THE DEPARTMENT OF ECONOMIC DEVELOPMENT'S WEBSITE WITH  EACH
 BID OPPORTUNITY AND SHALL BE UPDATED ANNUALLY.
   §  2.  This act shall take effect immediately, provided, however, that
 the amendments to subdivision 6-a of section 313 of article 15-A of  the
 executive  law  made  by  section  one  of this act shall not affect the
 repeal of such article and shall be deemed repealed therewith.
