 AN ACT to amend the election law, in relation  to  prohibiting  judicial
   candidates from enrolling voters in minor parties
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 1-104 of the election law is amended  by  adding  a
 new subdivision 3-a to read as follows:
   3-A.  THE  TERM "MINOR PARTY" SHALL MEAN A PARTY THAT, EXCLUDING BLANK
 AND VOID BALLOTS, RECEIVED LESS THAN TEN PERCENT OF THE TOTAL VOTES CAST
 FOR ITS CANDIDATE FOR GOVERNOR IN  THE  YEAR  IN  WHICH  A  GOVERNOR  IS
 ELECTED,  AND  LESS  THAN  TEN  PERCENT  OF THE TOTAL VOTES CAST FOR ITS
 CANDIDATE FOR PRESIDENT IN A YEAR WHEN A PRESIDENT IS ELECTED.
   § 2. The election law is amended by adding a  new  section  17-163  to
 read as follows:
   §  17-163. ENROLLMENT OF VOTERS IN MINOR PARTIES; JUDICIAL CANDIDATES.
 AN INDIVIDUAL HAVING RECEIVED NOMINATION AS A JUDICIAL CANDIDATE FOR  AN
 UPCOMING ELECTION IN ACCORDANCE WITH THE PROVISIONS OF THIS CHAPTER, WHO
 ENGAGES IN ANY CONCERTED EFFORT TO ENROLL VOTERS IN A MINOR PARTY, SHALL
 BE DISQUALIFIED FROM HOLDING JUDICIAL OFFICE.
   § 3. This act shall take effect immediately.
